The Property and conveyance are subject to: 1. Rights of parties in possession; 01078779 OR 9945 2 G 2. Any visible and apparent roadway or easement over or across the subject property, the existence of which does not appear of record; 3. Any and all restrictions, covenants, conditions, agreements, assessments, maintenance charges, leases, easements, and previously conveyed or reserved mineral and royalty interests, if any, relating to the Property but only to the extent they are still it effect and shown of record in the hereinabove mentioned County and State, and to all zoning laws, regulations, and ordinances of municipal and/or governmental authorities. TO HAVE AND TO HOLD THE Property, together with all and singular the rights and appurtenances unto the property in any manner belonging and any right, title and interest of Grantor in and to adjacent streets, alleys, and rights -of - way, to Grantee and assigns forever, and Grantor does by this instrument bind himself and his heirs, personal representatives, successors, and assigns, to warrant and forever defend all and singular the Property unto Grantee and its heirs, personal representatives, successors, and assigns, against every person lawfully claiming the Property, subject, however, as stated above.
