SUBJECT: 808 NIMITZ (ZBA)
I reviewed the above -mentioned ZBA VARIANCE application and determined it to be
incomplete. The following is the preliminary list of items needed to complete the submittal so
that staff may conduct a thorough review. Please submit the following information by 10 a.m. on
any Monday for review that week:
Brazos County Appraisal District records show that the property is currently
owned by Lawrence F. Guseman III. Mr. Guseman's signature must be provided
on the application, or provide proof of authority that John Rhodes has Power of
Attorney to sign the variance application on behalf of Lawrence F. Guseman 111.
A statement of the specific variance requests (question 1 on page 2). The
application states setback and lot dimensions variances are requested but does
not provide the specific dimensions requested — for example, a 2.5-ft. variance
to a 7.5-ft. side setback.
With these two items listed above, it may be best to fill out a new application form with the
required information. Please be aware that if this application is not completed before Monday,
December 5, 2011, it will expire and a new application and fees will be necessary to continue
the variance request process.

SUBJECT: 806 & 808 NIMITZ (ZBA) —Variance Request
Staff reviewed the above -mentioned variance application as requested. The following
page is a list of staff review comments detailing items that need to be addressed. If all
comments have been addressed and the following information submitted by Tuesday,
November 22, 2011, 10:00 a.m. your project will stay scheduled for the next available
Zoning Board of Adjustment (ZBA) meeting on Tuesday, December 6th, 6:00 p.m. in the
City Hall Council Chambers, 1101 Texas Avenue.

PLANNING
1. The specific waiver request to the front setback will need to be adjusted on the
application. When side yard parking is provided, the front setback can be reduced to
15 feet, as such the waiver request amount should be based off that amount.
2. Staff believes that the building setbacks should be at least a minimum of 7-feet from
the edge of pavement to mirror the location of other structures along Nimitz. The
drawing will need to be adjusted to reflect this change.
3. FYI, the property line for 806 Nimitz has changed with the minor plat that was done
last year. The area currently paved for Nimitz Street was dedicated to the City as
right-of-way. As such the setback will need to be calculated differently.
4. Staff will be recommending approval of the waiver requests, with the condition that
the property undergo a replat that includes right-of-way dedication for the section
along 808 Nimitz.
5. The request for the side setback reduction to 5-feet does not appear to be necessary
per the drawing. The drawing is showing 7.5 foot setbacks on each side.
6. Provide a legal survey of the two properties, showing all existing structures,
improvements, easements etc.
