I think it is fair to assume the fence and pad did not exist prior to the operations but were installed as part of the well site. As for planning's input outside of this, the site is zoned R-1 Single -Family Residential and is not currently platted. For the property to be utilized for any other use, it will need to be platted first. Also, I do not believe the current improvements comply with R-1 zoning and therefore should be removed with the abandonment of the well. Though I can't speak to Railroad Commission compliance and timing in plugging/closing the well, the city will certainly await this meeting before requiring the conditions of the well abandonment be fulfilled - as I had indicated to Alton as well. My understanding is that there is a city meeting February 16th, during which Alton will propose a zoning change. It is also my understanding that if a zoning change is approved, it will take app. 45 days and such change would allow Enervest to convey the pad to Mr. Ofczarzak as is. Can you please confirm that Enervest will be in compliance (subject to its normal course of plugging and abandonment procedures) and not susceptible to any fines during this interim period, as we hold off on restoring the location awaiting the zoning decision.
