Dear Mr. Gibbs,
I am a Landman working on behalf of Enervest Operating LLC in the plugging and abandonment of the Boriskie-
Diversified #1 well in College Station.
Thus far, we have worked with Donnie Willis in Planning and Development to fulfill the procedures required by
the City of College Station.
I have also been in discussions with Mr. Ofczarzak (Oakwood Custom Homes Group, Ltd.) , the landowner of
the drill site, who has requested the pad, gravel, and fencing around the perimeter of the pad to be left intact
for his future planned use.
Please review his request along with a Brazos County description of the subject property.
If there is any other material or information I can provide you with, please don't hesitate to contact me.

Alan,
From my reading of the ordinance, it appears that when an oil well is abandoned the property is required to be
restored to the same surface conditions as existed before the operations commenced. I think it is fair to
assume the fence and pad did not exist prior to the operations but were installed as part of the well site.
As for planning's input outside of this, the site is zoned R-1 Single -Family Residential and is not currently
platted. For the property to be utilized for any other use, it will need to be platted first. Also, I do not believe
the current improvements comply with R-1 zoning and therefore should be removed with the abandonment of

I wanted to get your planning input on this request - as far as this type of use. Donnie can get you Oil and Gas
chapter and verse, but the regs indicate the pad should be removed as part of the "abandonment"

I spoke with Alton recently as well. There is a meeting scheduled to discuss this at 4pm on Feb 16th here at
city hall. Though I can't speak to Railroad Commission compliance and timing in plugging/closing the well, the
city will certainly await this meeting before requiring the conditions of the well abandonment be fulfilled - as I
had indicated to Alton as well.

Alan/Donnie,
I spoke with Alton Ofczarzak this week regarding his discussions with you regarding a change in zoning for the
Boriskie-Diversified location pad.
My understanding is that there is a city meeting February 16th, during which Alton will propose a zoning
change. It is also my understanding that if a zoning change is approved, it will take app. 45 days and such
change would allow Enervest to convey the pad to Mr. Ofczarzak as is.
Can you please confirm that Enervest will be in compliance (subject to its normal course of plugging and
abandonment procedures) and not susceptible to any fines during this interim period, as we hold off on
restoring the location awaiting the zoning decision.
