HomeMy WebLinkAboutMisc.Faith Investments August 5, 2013 To whom it may concern, Faith Investments bought a 2.58 acre tract in the Robert Stevenson League A —54, College Station, Texas, known as 727 Graham Road. The seller of that tract was Texas A&M Research Foundation. The contract for that sale had the following provision: "Seller or Seller's successors or others under Seller's or Seller's successors' direction will plat and complete a 50 foot access easement from Graham Road to an 8.973 acre tract (2083/138) on the Northwest side of this tract. That access easement will be along the east side of the Property the subject of this contract but on the adjacent 2.60 acre property. Seller has agreed to provide two additional access points to this Property from the 50 foot access easement, curb cuts, at approximately 93 feet and 253 feet from the corner of this Property located at the intersection of the access road and Graham Road. Buyer and Buyer's invitees will have use of the access easement. Buyer's or Buyer's successors' rights for the use of the adjacent easement and curb cuts shall survive closing but are contingent upon Seller or Seller's successors establishing the easement. Buyer acknowledges and agrees that Seller makes no representation or warranty as to when the 8.973 acre tract will be platted or when the 50 foot access easement will be constructed. This provision will survive closing." It appears that construction for the completion of the 50 foot access easement may be imminent. The purpose of this letter is to confirm that when the access road is actually constructed in this 50 foot easement (and the two access points are provided to the Faith Investments property as required in the contract of sale) that the existing driveway on the Faith Investments property (which currently accesses Graham Road directly) will be closed. for Faith Investments 727 Graham Rd.
