THE EFFECTIVE DATE OF THE AGREEMENT, THE DATE OF ESCROW RECEIPT, IS MARCH 10, 20'0, THE PARTIES WISH TO CLARIFY SOME OF THE INFORMATION IN THE CONTRACT. IT IS AGREED that: 1. The Property the subject of this contract is described by the metes and bounds description attached as EXHIBIT A. Z Seller or Seller's successors, or others under Seller's or Seller's successors' direction, will plat and complete a 50 foot access easement from Graham Road to an 8:973-acre tract (2083/138) on the Northwest side of this tract. That access easement will be along the east side of the Property the subject of this contract but on the adjacent 2.60 acre property. Seller has agreed to provide two additional access points to this Property from the 60 foot access easement, curb cuts, at approximately 93 feet and 253 feet from the corner of this Property located at the intersection of the access road and Graham Road. Buyer and Buyer's invitees will have use of the access easement, Buyer's or Buyer's successors' rights for the use of the adjacent easement and curb cuts shall survive closing but are contingent upon Seller or Seller's successors establishing the easement, Buyer acknowledges and agrees that Seller makes no representation or warranty as to when the 8.973 acre tract will be platted or when the 50 foot access easement will be constructed.
