We are preparing the check now, for delivery tomorrow. I will attach a letter as requested. We have three loads of dirt
in the bottom of the pond now, just need to be graded and sodded. We will also hand dig/clean pipes.

Okay, the issue with the easements is resolved. What is status of silt removal from culverts and detention pond
repairs? If work has not been completed, receiving a full CO from engineering side will require surety with letter
indicating what surety is covering and timeframe for completion. Also need acknowledgement of outstanding amended
drainage report and schedule for completion and submittal to City.

RE: Caprock Crossing Detention Pond 2 (SP)—14-00900177
Ms. Cotter:
This letter is an update on the construction progress for the abovementioned detention pond. The
detention pond varied from the original construction plans, however, detention pond and
associated pond volumes are comparable to those of the construction plans and designed
detention pond. The detention pond should function as designed to mitigate increases in
stormwater runoff produced from upstream development. Modifications will still need to be
made to prevent standing water in the bottom of the pond. Due to weather conditions the
modifications to the pond will need to be postponed until we experience a substantial dry period
to allow the pond to dry out. The developer has provided a financial surety for the remaining
construction work and has given approximately 6 month time frame on completing the
construction of the pond, weather permitting. Upon completion of the detention pond
construction an amended drainage report will be submitted corresponding to the pond as built on
site.

Folks,
I've attached a photo of the downstream drainage channel. Based on the depth of sediment, underbrush and tree
growth, this issue is clearly decades old and not caused by our construction. We do not intend to do any further work
on the neighboring tracts - as we absolutely did not cause this obstruction.
We are re -contacting the utility companies to get their written approval of this work. We are competing the hydroseed
on the pond later this week. We understand full acceptance by the city will not occur until the pond is vegetated.
As far as the pond holding water, we have struggled over and over to fix the pond bottom, but the fact that water
continues to accumulate there (as intended) makes the fine grading very tough. Our intention is to keep plugging away
at the pond bottom as dry weather permits. I understand the maintenance concern and we will address it one way or
another.

Detention Pond not accepted as currently constructed. Pond needs to grade to drain. Although this is
an interim pond, maintenance is required which will be difficult if not impossible in current state. Pond
will also need to be vegetated as well as other disturbed areas. You mentioned culverts partially
plugged with sediment. Since it is not clear that it wasn't a result of construction activities, contractor
should be responsible for cleaning them out in order for pond to function as intended.
I am unable to find the response to staff comments No 2, which might address this, but more of the
pond berm is constructed within the existing PUEs than previously approved. If you recall, I had
concerns with the impact the berm would have on maintenance of the various utilities. There was
minimal encroachment with pervious design. Did TMPA, BTU and Wellborn SUD have specific
requirements for berm in PUE and provide consent?
Please provide an amended drainage report reflecting new design.

The DP has a portion of the levee reshaped but has been wallowed out into a mud pit. See attached
photos.
There is a track vehicle still on site. They may know they are not finished shaping the pond.
It holds water in three places.

BTU has reviewed the drawings and has visited the site.
BTU approves of the installation; however, BTU reserves all rights as defined under the filed easement documents for
this property.
Should vegetation or structures impinge on BTU's rights, they may be altered or removed at a future date as needed to
restore those rights.
