Quite frankly, the city staff is wrong in saying there is a site issue... it would have been s very professional step for them to take in coming out and looking at specifically what we were referring to. Having come out one time last November is not acceptable based on the number of changes we made to our plans based on what the ZBA suggested. What's even more frustrating is that there are numerous infractions all over this neighborhood ... there's a fence at the corner of Park Place and Welsh that you have to drive halfway into the street to see if there is a car coming. The students park haphazardly in front of their rental homes creating even greater issues... Unfortunately, the city chooses to ignore those. We're very frustrated and very disillusioned with the City of College Station and this department. Dresser" <g-dresser@suddenlink.net> To: "Matt Hilgemeier" <mhilgemeier@cstx.gov> Date: 4/22/2010 10:29 PM Subject: ZBA Hearing Request April 22, 2010 Mr. Matt Hilgemeier and members of the Zoning Board of Adjustment The purpose of this letter is to support the application of Linda and Russell Harvell, 504 Guernsey Street, College Station 77840 for a new hearing before the Zoning Board of Adjustment. I know that the ZBA has to operate under a strict set of rules and guidelines. However, sometimes we as board members and City staff have to just use common sense and do what makes sense, do what is fair, do what is right. As a former volunteer with the City of College Station, (six years P&Z and four years Parks and Recreation) my experience was that when we put our minds to it we could find a way to do what made sense within the requirements of the ordinances, rules, and guidelines that governed our decisions. I am very pleased to have the Harvells as neighbors. They have made a significant investment in their residence which benefits me, the other nearby property owners, and, of course, the City, the County, and the School District. They are asking for a variance to the set back dimension requirements to build a detached garage in a location on their lot, which maximizes the utility of their lot, preserves the existing trees, and fosters drainage. What they are asking for is in keeping with the character of the neighborhood and, more specifically, is not any different from the setback dimensions previously approved by the City at the request of the Harvell's adjacent neighbors to the south. I have come to the conclusion that it is probably impossible to write an ordinance that will accomplish everything that the planners that wrote it and the council members that approved it had in mind. Even the most casual of observers will see that most of the residential investment that has been made in this neighborhood during the past five years and continuing to this day has been in multi bedroom and multi bath rental residences intended for university students. This was not the intention of the single family residential ordinance but, for sure, it was one of the results. So why, when someone wants to build an authentic single family homestead, do we make it so hard for them to do so? It simply does not pass the common sense test. To me, it seems shortsighted and arbitrary. We can and should do better. I am sure that when the City staff and the ZBA members put their minds to it they can find a legal way within our rules and regulations to grant a new hearing and subsequently a variance.
