Hovde, Staff Planner Ihovde@cstx.gov RECOMMENDATION: Staff recommends approval of the requested variances as previously approved, including the sidewalk variances with conditions. These variances were previously approved with the September 2009 Preliminary Plat and are being requested again as a housekeeping item. Staff recommends approval of the revised Preliminary Plat. Preliminary Plat: This property was included in the 1997 Master Plan of the Crowley Tract and first preliminary platted as Tower Point in 2006. The preliminary plat was revised in 2008 and again in September 2009. The last preliminary plat was approved with the same variances as currently requested. The proposed preliminary plat amends the phasing for the plat and has modified some lot configurations. Site development: Vacant with an established regional detention pond. There is an approved site plan for Scott and White Medical Clinic on Phase 1 B. COMMENTS Water: There are existing 24" waterlines along the SH 6 Frontage Rd. and William D. Fitch Pkwy. There are also 12" waterlines along Arrington Rd. and Decatur Dr. Domestic water service and fire protection is required to be extended to all lots Sewer: There are existing 12", 15", 21 ", and 27" sanitary sewer trunk lines through the property. A public sewer main is required to be extended to all lots. Streets: Arrington Road and Decatur Drive have been constructed as two-lane major collectors as a Capital Improvements Project. Off -site Easements: None at this time. Drainage: There is an existing regional detention facility. Flood Plain: FEMA designated floodplain for Spring Creek is located on this property. A LOMR is currently being prepared for submittal to FEMA to reflect current conditions. Finished Floor elevations have been determined for the lots impacted by the floodplain. Oversize Request: None requested. Impact Fees: The majority of the property is located in the Spring Creek Sewer Impact Fee Area (97-01). Currently, the Impact Fee for this area is $98.39 per Living Unit Equivalent. Impact Fees are due at time of Building Permit. Multi -Use Path: The Bikeway and Pedestrian Master Plan shows that a greenway trail (multi- use path) following Spring Creek is identified in the area labeled as detention area on the preliminary plat. The dedication of a 30-foot Public Access Easement in this area has been processed and is currently awaiting signatures. Planning & Zoning Commission Page 3 of 5 November 19, 2009 REVIEW CRITERIA Compliance with Comprehensive Plan and Unified Development Ordinance: The proposed preliminary plat is in compliance with the Comprehensive Plan. As proposed, the subdivision requires variances to the subdivision regulations contained in the Unified Development Ordinance. Section 8.2.A.10.b Block Lengths states that blocks shall not exceed 800 feet in length. The following block lengths are proposed and require variances: • State Highway 6 - approximately 1000 feet between Lot 8 Block 3 and W.D. Fitch, requiring a variance of 200 feet • State Highway 6 - approximately 1350 feet between Lot 8 Block 3 and Arrington Road, requiring a variance of 550 feet • William D. Fitch Parkway - approximately 980 feet abutting Phase 7, requiring a variance of 180 feet • Arrington Road — approximately 920 feet on the west side between Lot4 Block 5 and the round -about, requiring a variance of 120 feet • Arrington Road — approximately 2294 feet on the west side abutting Block 4, requiring a variance of 1494 feet • Arrington Road — approximately 2178 feet on the east side abutting the detention area, requiring a variance of 1378 feet Section 8.2.13.13 Sidewalks of the Unified Development Ordinance requires sidewalks to be constructed on both sides of all streets having a right-of-way width equal to or greater than sixty feet. The applicant is requesting that no sidewalks be required along State Highway 6 Frontage Road and William D. Fitch Parkway. This variance was approved in September with the condition that alternate means of pedestrian and bicycle connectivity is provided. Previously, the Planning and Zoning Commission made the following findings and approved the variances: 1. That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; 2. That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; 3. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; and 4. That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. Planning & Zoning Commission Page 4 of 5 November 19, 2009 STAFF RECOMMENDATION Staff recommends approval of the block length variances and sidewalk variances with conditions as previously approved by the Commission in September. If all variances are approved, Staff recommends approval of the Preliminary Plat with the condition that construction documents are approved. SUPPORTING MATERIALS 1. Application 2.
