That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land, Five (5) of the lots desired to be replatted (Lots 28-32) are currently platted in the F.S Kapchinski, Block One subdivision and are land locked. In order for the proper development of these, and other lots, to occur a public street will have to be extended to and in some cases through the land locked property. To support this infrastructure improvement, along with required detentioning, the developer will need to create six (6) lots that meet all other ordinances but are under the required minimum square footage area and have a minimum lot width less than the existing calculated block average. However, it should be noted that four (4) of the 5 lots (Lot 18Ri, 18R2, 24R1, and 24R2) that do not meet the calculated average lot width will not change. Their current lot width and configuration is already below standards and current existing development prohibits this development from increasing their respective widths. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; Page 1 of 2 F.S. Many of the surrounding existing residential developments contained dual dwelling units per lot but are simply contained on a singular lot. This development will allow for the same density to occur in nature but rather have a single dwelling unit per residential lot. 3. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; The grating of this variance will not be detrimental to the public health, safety, or welfare. The proposed development is consistent with existing adjacent developments. Also with the replatting of this property land issues will be resolved by providing all lots with proper right-of-way frontage. Another benefit to the public health, safety, and welfare will be the rerouting of drainage of the construction of the proposed street. Currently significant runoff is reported to cross NW '/z of Lot 18. With the construction of the proposed street runoff will be diverted around this lot and into the existing drainage facilities located on Park Place. 4. That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. No adverse impacts to future developments are perceived with the granting of this variance. Much of the neighboring property is developed in the same nature that this replat is proposing. Page 2 of 2
