Regarding the specific request to consider concurrent reviews of the comprehensive plan amendment and the rezoning, the city policy has been very clearly established. The City Manager, Planning And Zoning Commission, and City Council have all clearly stated a policy that comprehensive plan amendment requests must be addressed prior to the consideration of rezoning requests. There are a variety of reasons for this policy but perhaps most significant is that each request involves significant differences in what factors are considered and to what degree. For example a rezoning request often involves scrutiny of the timeliness of the request (is this the right time to permit a requested land use) where as a comprehensive plan amendment is more focused on the appropriateness of a land use at some point in the future of the community (be it now, or 20 years from now). Blending of these considerations has caused great confusion and can lead to poor land use decisions. Further, there is a more practical concern that you should be aware of. Currently we have tentatively scheduled the comprehensive plan amendment on the November 6th P&Z meeting. That meeting currently has more than 20 items tentatively scheduled for hearing. Obviously, that may be more items than the P&Z can handle on a single meeting. It is possible that some of the items (including your request) may have to be moved to a later meeting to make a more manageable meeting. Though the items will be separated in accordance with city policy we will continue to review your projects in as timely a manner as possible and will keep your other deadlines in mind as we proceed. Kee, IPS Group Re: Request for Rehearing (Agenda Item #6, April 2, 2009 P&Z Meeting) My clients, Mr. Bart Munro and Mr. Gene Savage appreciate the opportunity to discuss the possibility of a rehearing for the comp plan amendment that was denied last December. However, since our original request for a rehearing, we have had a change to review the draft Land Use Plan during the Community Open House. As it is showing approximately 5 acres of neighborhood commercial at the corner, which is what we originally wanted, we are withdrawing our request for a rehearing. Instead we will be vigilant thru the comp plan adoption process, not only to see that 5 acres of neighborhood retail remains on this comer, but also to work with the City on reconfiguring the remaining 3 acres, which presently shows an illogical and very unusable land use pattern with a very narrow strip of medium density SF along a major fixture highway.
