Great, thanks! Did you have a chance to think about my question yesterday... does the language in this
ordinance cover the private utilities (i.e. verizon, atmos, etc.) that may be in the existing right-of-way?
Public utilities were referenced several times, but I wasn't sure if this included our private franchisees
too.

We'd like to request to vacate this 20' PUE (attached) initially created to serve Rock Prairie Heights
wastewater needs over to the Carters Creek manhole based on the following reasons:
-Rock Prairie Heights project plans, plat, etc will never happen now that S&W owns the land and intends
to follow the approved concept plan.
-realignment of facilities for CS Electric and BTU show no need to use this easement
-the S&W prelim platting process has determined the need for 15' of additional ROW along this frontage
of Rock Prairie
-additional easements along Rock Prairie are not needed based on design effort and engineering behind
the plans for water, stormwater and wastewater to bring services that drain these wet utilities to the south
and away from Rock Prairie.
Please advise on what you'll need from Weingarten, if anything, or S&W to support this request and what
process I need to follow - I'd like to get this vacated prior to Final Plat approval and recordation.

Joel,
The standard abandonment application with all signatures will need to be submitted. Along with that, we
will need a letter of confirmation from Weingarten that the sanitary sewer line (for which we have
approved plans) is not intended to be built within that easement. We would also accept a letter
requesting to withdraw the original application for the Rock Prairie Heights plat and associated
development permit.

Subject: S&W Abandonment
Erika,
I'm reviewing this ordinance for the January 13th agenda and have a couple of follow up questions:
1. The ordinance references the need for public access to platted lots, emergency access and sanitation
purposes. Do we need to retain an easement for these things or does the City just need a utility
easement?
2. The two adjacent owners who are required to consent to the abandonment conditioned their
consent on construction of S&W Drive. Seems like we should condition the abandonment on the
construction and acceptance of that new road. What do you think?
