I am writing you on behalf of my client, DNC, Inc., regarding the City of College Station's requiring my
client to bear the expenses associated with boring under College Main to oversize the waterline to serve 301 College
Main. Said requirement to oversize the waterline resulted from the City of College Station requiring that 301
College Main be sprinkled due to an ordinance requirement.
Until the present, Suite A was operated as a financial institution and Suite B, a sandwich shop. The
existing 2 inch waterline is more than sufficient to meet the needs of both businesses. Said waterline is still more
than sufficient to meet the needs of the new business that will be occupying 301 College Main, Suites A & B.
My client has not increased the size of the building, but has simply joined the two suites together. As a
result, the City of College Station has required that the entire premises be served by a fire sprinkler system. As a
result, the City of College Station has required the installation of 4 inch waterline. Said waterline is to be used by
not only my client, but will serve adjacent property as well.
The only waterline large enough to tie the new 4 inch waterline is located on the opposite side of College
Main necessitating boring under College Main to tie into said line.
My clients do not have a grievance about having to pay to have a fire sprinkler system, and are willing to
bear said cost. However, my clients do not feel that they should bear the cost to bore under College Main to over
size the line. This expense is a result of the City requiring a property owner to oversize the City's line for the
benefit of other property owners, and as such, they should not bear the cost of boring under College Main and
oversizing said line.
The invoices for boring and oversizing are attached hereto as Exhibit "A". The total cost is $24,647.50 as
reflected on the attached invoice from Brazos Paving, Inc. This letter shall serve as a request for the City to
reimburse my client said $24,647.50.
