That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; This variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant. 3. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; and Rock Prairie Road West was constructed without curb and gutter and no subdivision located along either side of the road currently have sidewalks. 4. That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. The Future Land Use and Character Map classifies the subject property as General Suburban which allows for the development of high -density single-family lots. The granting of this variance would not prevent the subdivision of other land in the area in accordance with this chapter. If the variance is approved, the plat will be in compliance with the Section 8.2 of the Unified Development Ordinances. The Planning and Zoning Commission also has one discretionary item to consider regarding Section 8.2.A.10 Block which allows for the requirement of a pedestrian access way to be required along blocks exceeding 800 linear feet. An access way is defined as a 10-foot wide right-of-way dedication and should include the construction of a 4-foot wide sidewalk. This pedestrian access way is not being proposed at this time. If an access way is required, the applicant will also need to add a sidewalk along Cullen Trail which is not required by the Unified Development Ordinances because it is a cul-de-sac street. The addition of an access way in this location will result in the loss of two lots. STAFF RECOMMENDATION Staff recommends approval of the sidewalk variance request along Rock Prairie Road and approval of the Preliminary Plat.
