267 and 269,respectively, filed on the 2nd day of September, 1998(the"Property"); a
WHEREAS, WELLBORN ROAD LIMITED desires to create and prov;ile •� tee
development and improvement and maintenance of said WILLOW RUN `,l'._.it\"i`ION.
PHASES 3A and 3B for the mutual benefit and pleasure of the present and futurr property owners
in such Subdivision, and to protect the property values within such Subdivision by imposing upon
and against all the designated lots therein the covenants, reservations, restrictions, and other
provisions hereinafter set forth;
NOW THEREFORE, WELLBC•IN ROAD LIMIT ED does hereby make, adopt and
establish the following reservations, restrictions, declarations,
agreements,covenants,conditions, and stipulations,each of which shall applicable to WILLOW
RUN SUBDIVISION,PHASES 3A and 3B according to the plats filed of record in Volume 3244,
Pages 267 and 269,respectively,of the Official Records of Brazos County,Texas.

The following words when used in this instrument shall have the following meanings:
A. "Wellborn" shall mean Wellborn Road Limited,a Texas Partnership,its successors and
assigns.
B. "Subdivisiou"shall mean Willow Run Subdivision, Phases 3A and 38,as per thelats
filed of record in Volume 3244. Pages 267 and 269, P
Records of Brazos County, Texas. pectively, of the Official
C. "Recording Dam"shall mean the date upon whic;t .his

mortgage, unless and until such mortgagee has acquired legal title
foreclosure or any proceeding in lieu of foreclosure. The term "Owner" hall further 2
include any person or entity claiming title to any lot or portion thereof by adverse
possession, any person or entity leasing, renting or otherwise occupying any lot or part 4
thereof. and any person or entity claiming interest in a lot or part thereof under a 5
contract of sale.
F. "Representative" shall mean a person, persons, or entity designated in a document of
record in the Official Records of Brazos County. Texas as the representative of 0
Wellborn with the authority set forth herein and/or in said document.

WELLBORN hereby dedicates to the Public a perpetual utility easement in, along, under, 1
over,across,and through those areas on the plat of said subdivision designated for such easements,
said plat being referred to in paragraph I.B. above. Utility companies shall have the right to
construct, operate, maintain, inspect, reconstruct, multiply, change the size of and remove such
utility lines and facilities (including without limitations of the generality thereof, water, sanitary
sewer, storm sewer, drainage and gas pipes, mains, conductors, and all appurtenances thereto and
electric distribution and communication lines,wires,conduits,guy wires,poles,connections and all
appurtenances thereto),as it or they may from time to time desire,together with the right of ingress
and egress thereto. The width of the utility easements hereby reserved are as shown on said plat
and shall extend below ground level sufficiently to accommodate utilities and extending upward to
a plane of sufficient height above the ground to include utility equipment as constructed.

For the purpose of creating and carrying out a uniform plan for the parcelling and sale of the
Subdivision as a district set aside for residential homes and certain other uses accessory thereto,the
following restrictions, including without limitation restrictions, covenants, declaration, easements,
limitation,charges,agreements,and conditions(hereafter collectively called the"Restrictions"),are
hereby established and adopted to apply uniformly to use, occupancy and conveyance of all the
parcels in the Subdivision. Every contract, deed or conveyance which may be hereafter executed
with regard to any of the property in the Subdivision shall be conclusively deemed to have been
executed, delivered and accepted subject to the following Restrictions, even if the Restrictions arc
not set out in full and are not incorporated by reference in such contract of sale,deed, lease or other
tran_fer of and interest in such parcel.

1- Except as herein otherwise provided, each parcel in the Subdivision (except possibly, a
reserve arra) shall be used only for non-commercial residential and recreational purposes.
Only singlefamily residential dwellings and appurtenances ordinary to residential living
shall be permitted. All appurtenances shall also require the approval of the Representative
(as defined in I. F. above). To this end, without limitation, the followingstructures

homes,
duplex houses, apartment houses, mobile homes, hotels, or any retail wholesale, or 3
other business or commercial establishments of any kind_ Notwithstanding the above, 2
consulting or similar in-home business activities that have limited customer activity shall be
allowed. The Representative shall have the right and power to stop or restrict any such in-
house business activity if the Representative determines in his sole discretion that the 5
business or activity is detrimental to the Subdivision.
2_ The authority of WELLBORN and/or the Representative, as stated in this Declaration,
continues until such time as (1) WELLBORN ceases to own any of the lots subject to this 0
Declaration,and(2)WELLBORN, in its sole discretion,notifies the lot owners and records 0
in the Official Records of Brazos County. Texas a doctunent laminating its authority and
responsibilities in said Subdivision. Accordingly,each lot owner shall then have the right to i
enforce the restrictions in said Subdivision as provided by.Texas law, to include formation 8
of a Home Owners Association if so desired. 2
3. No residence shall be constructed on any parcel that has an underroof living area,excluding
porches, garages, patios and the like, of less than 2500 square feet. Construction of main
dwelling,once begun,shall be completed in no more than 24 months.
4. Only one single family dwelling and appurtenances thereto such as garages, outbuildings,
barns,stables,and the like. may be placed or constructed on each of the parcels as platted as
of the recording date; provided, however, that one, and no more than one, single family
dwelling and its appurtenances may be placed or constructed within each subdivided lot as
set forth in Article IV,hereof,
5. No building or structure except fences may be located on any parcel nearer to the front of the
property line than one hundred fifty (150) feet, or nearer to either side of the property line
than fifty (50) feet or the back property line than fifty(50)feet. However, in no event will
such set back lines be less than those set by governmental requirements. The front side of
the parcel is that side which abuts a street Parcels that abut on two streets shall be deemed
to front on both streets, except those lots fronting Capstone Drive, in which case the front
shall be deemed to be either Alacia Court or Suzanne Place.
6. No residential dwelling shall be built without a State of Texas or other required
governmentally approved septic tank or other sewage disposal system that is so approved.
7. The color scheme, design, height, configuration and location of all structures, including, but
not limited to garages, barns, outbuildings, stables and the like located on a lot shall be
similar to appearances to the principal residence located thereon. Approval to build may be
denied if the Representative is of the opinion that such color scheme. design, height,
configuration or location will be detrimental to the Subdivision or an adjoining lot or parcel.
8. To ensure a consistency of design,appcarances,and materials throughout Willow Run Phases
3A and 3B. all fences fronting (as further defined below), Capstone Road, Alacia Court,
Suzanne Place and Apricot Glen Circle`must conform to the following standards: (I) the
style 'Post and three rail', in the color white, (2) constructed of either wood or potyvinal,
(3)a minimum/maximum height of 51-53 inches, a minimum/maximum rail width of 5 - 6
inches, and the fence (4) aligned with contiguous neighbors fencing (if such exist) and
placed 'on' the property line parallel and contiguous to the aforementioned streets. No other
fence shall be permitted within 100 feet (50 feet in the case of Capstone Drive)of the street
property line unless a fence meeting the four standards exists. WELLBORN has installed the
"Post and three Rail" fence on each lot fronting Capstone Drive; this fence has conveyed

with associated ownership and maintenance responsibilities to each respective lot owner. 3
The term "...all fences fronting"does not require that an owner construct a fence on the 3
streets Alacia,Suzanne or Apricot Glen, but in the event they elect to do so,such fence shall2
meet the four standards as set out above. 'Side fences' or 'back fences' are not required to 4
meet those standards and may be constructed as the owners needs and wishes dictate. 5
9. Driveways,if unpaved,shall be surfaced in crushed stone or gravel,or similar material.
B. GENERAL RESTRICTIONS

projects,and not beyond that period. Horses arc permitted but limited to one adult(over one
(1) year of age) animal per acre of area in the lot, fractions of an acre being excluded.
Offspring arc permitted until they become adult at which time they are subject to the area
limitation.
3. No part of the Subdivision shall be used or maintained as dumping grounds for rubbish.
Trash, garbage or other equipment for the storage or disposal of such material shall be kept
in a clean and sanitary condition. Owner will contract with a regularly scheduled trash pick-
up service if it is available.
4. No act may be performed which is likely to pollute the air or water in any part of the
Subdivision, nor may any property owner violate, any ordinance designated to eliminate
pollution at that time in force whether it be State County of City.
5. No firearms or fireworks may be discharged in the Subdivision or on any parcel, easements
or common area. No hunting of any kind will be allowed.
6. No oil or gas drilling, development, refining, quarrying or minin operations
shall be permitted on the surface of any lot, nor shall anygtun oany kind
wells,
excavations or shafts be mss. ��s�, mineral
permitted on the surface of any lot. No derrick or other structures
designed for use in boring or drilling for oil, natural gas, or other mineral shall be erected,
maintained or permitted on any lot. This paragraph does not
part of the Subdivision with otherprohibit the pooling of all or

Limited reserves the right to utilize the surface of Lot 15, of this Subdivision for the

IV.
RE-S tBDIVIctl
Any lot containing five(5)or more acres may be re-subdivided into smaller lots of not less
than tv►o and one-half(2.5)acres each. Each such subdivided lot must make provisions for water to
be furnished by Wellborn Water Supply Corporation. and shall be
ject to the then existing
regulations affecting subdivision in Brazos County, Texas, and subject to same restrictions as set
forth in this document.

WATER SURFACE 2
The Subdivision is serviced by Wellborn Water Supply Corporation. Each Lot Owner
desiring said water service shall be required to contract directly with Wellborn Water Supply 5
Corporation. Thc cost of water,tap fees,membership fees,expansion reserve fees,installation fees,
monthly use fees and meters shall be subject to the fee schedule of Wellborn Water Supply
Corporation and paid by the Lot Owner. This paragraph does not prohibit owner from having his
own well subject to appropriate health ordinances.
VI.
MISCELLANEOUS PROVISIONS i
1. The foregoing Restrictions are adopted as part of and shall apply to each and every parcel in the 8
Subdivision. Such Restrictions arc equally for the benefit of all subsequent owners of parcels in
the Subdivision and accordingly, shall be covenants running with the land. Any owner of 4
lienholdcr of any of the property or the Association shall have the power to prosecute in the
appropriate court a suit at law or in equity to prevent any violation or attempted violation of the
Restrictions and to recover damages for any violation or attempted violation including, but not
limited to, reasonable attorney's fees; provided, however, that this clause shall not restrict any
governmental agency from acting to enforce any of the Restrictions.
2. The term of the Restrictions shall be for a period from the filing of this instrument for record in
Brazos County,Texas, until the 30'day of June,2012, after which such date such Restrictions
shall be automatically extended for successive periods of ten (10) years each, unless and until
by instrument executed by the then record owners of a majority of the parcels in the
SUBDIVISION and duly recorded in Official Records of Brazos County, Texas, such
Restrictions arc altered.rescinded.modifiedor changed,
3. Nothing contained in this document, nor any violation of any of the le or tR nAstrictions shall have the
effect of impairing or affecting the rights of any mortgagee, or trustee under anymortgage
deed of trust outstanding against all the subdivision or any or

Bh reservations of WELLBORN herein contained may be assigned
to any person, corporation, or association which will assume the duties pertaining to the
particular rights, powers, and reservations assigned, and upon any such person, corporation, or
association's evidencing its consent in writing to accept such assignment and assume such
duties, he or it shall, to the extent of such assignment, have the same rights and powers and be
subject to the same obligations and duties as arc given to and assumed by WELLBORN, herein
and WELLBORN shall thereafter be released from any future liabilities. The term
WELLBORN as used in this document includes a.; such assignees and their heirs, successors,
and assigns.
S. Every person who now or hereafter owns or acquires any n
property in the subdivision is and lit, title or interest in or to any

reference to this declaration is contained in the instrument by which such person acquires an
interest in the property.
6. WELLBORN reserves the right to make minor deviations from the terms of this document to
theextent permissible by law and consistent with the general plan for development as herein set

7. The invalidity, violation, abandonment, waiver of or failure to enforce any one or more of or 3
any part of the provision of this document shall in no way effect or impair the remaining 2
provisions or parts thereof which shall remain in full force and effect.
8. WELLBORN, its successors and assigns,shall have the right to bring within the scheme of this 4
Declaration additional properties thereby subjecting such additional lands to this Declaration, 5
by filing of Record, a Supplementary Declaration with respect to such additional property
which shall extend the scheme of this Declaration to such property.
Such Supplementary Declaration may contain such complementary additions and modificationsei
of the covenants and restrictions contained in this Declaration as may be necessary to reflect the 0
different character, if any,of the added properties as are not inconsistent with the scheme of this
Declaration. In no event, however, shall such Supplementary Declaration revoke, modify 1add to the covenants, by this Declaration within the existing subdivision. or 5

DECLARATION OF COVENANTS, CONDITIONS, RESERVATIONS AND RESTRICTIONS
OF
WILLOW RUN SUBDIVISION, PHASES 3A AND 3 B
STATE OF TEXAS §
§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS §
This Amendment to Declaration of Covenants, Conditions, Reservations and Restrictions
of Willow Run Subdivision, Phases 3A and 3B (this "Amendment") is entered into as of the .
day of December, 2013 by Anthony J. Best and Gloria J. Best as legal owners of Subject Lots
(as defined below) and as attorney-in-fact for the Owners of the Lots in the Subdivision
described on Exhibit "A" attached hereto and made a part hereof. All capitalized terms used
in this Amendment unless otherwise defined in this Amendment shall have the same definition
and meaning as set forth in the Declaration.
RECITALS:
WHEREAS, Wellborn Road Limited, a Texas limited partnership ("Wellborn Road"),
executed that certain Covenants, Conditions, Reservations and Restrictions of Willow Run
Subdivision. Phases 3A and 3B, dated July 27, 1998, and which was recorded in Volume 3245,
Pages 180 through 185 in the Official Records of Brazos County, Texas (the "Declaration")
establishing certain restrictive covenants, reservations, restrictions, declarations, easements,
limitations; charges, agreements, conditions and stipulations applicable to WILLOW RUN
SUBDIVISION, Phases 3A and 3B, according to the plats filed of record in Volume 3244, Pages
267 and 269, respectively, of the Official Records of Brazos County, Texas (the "Subdivision");
WHEREAS, pursuant to its rights in Section 2 of the Declaration, Wellborn Road
terminated its authority and all responsibilities and/or obligations of any kind as to said
Subdivision effective as of December 1, 2000, as evidenced by that certain Declaration
Regarding Willow Run Subdivision, Phases 1, 2, 3A and 3B recorded in Volume 3996, Page
129 in the Official Records of Brazos County, Texas;
WHEREAS, Anthony J. Best and Gloria J. Best (individually and collectively, their
successor and assigns, the "Subject Lot Owner") currently own Lots Fifty-six (56) and Fifty-
seven (57), Willow Run, Phase 3A, Brazos County, according to plat thereof recorded in Volume
3244, Page 267 of the Official Records of Brazos County, Texas (individually and collectively,
the "Subject Lot");
WHEREAS, the Declaration contains certain setback restrictions for the Lots;
WHEREAS, the Subject Lot Owner desires to build certain new residential improvements
on the Subject Lot which requires certain modifications to the Declaration;
WHEREAS; Section Vl.2 of the Declaration allows the Declaration to be modified or

NOW. THEREFORE, the undersigned as legal owners of Subject Lot and as attorney-in-
fact for the Owners of the Lots in the Subdivision described on Exhibit "A" attached hereto and
made a part hereof along with John W. Brooks and Karin M Brooks as owners of Lot 24, Willow
Run, Phase 3B, Brazos County, according to plat thereof recorded in Volume 3244, Page 269 of
the Official Records of Brazos County, Texas (individually and collectively, the `Lot 24 Owner"),
hereby declare, adopt, grant, and establish the following modification to the Declaration as more
fully set forth in this Amendment.
1. The foregoing recitals are incorporated into this Amendment as if fully set forth herein. For
purposes of this Amendment, the Subject Lot Owner, the Lot 24 Owner and each Owner of the
Lots in the Subdivision described on Exhibit "A" attached hereto and made a part hereof shall
be referred to from time to time as the "Consenting Parties".
2. Section III.A.(5) of the Declaration currently states that "No building or structure except
fences may be located on any parcel nearer to the front of the property line than one hundred
fifty (150) feet, or nearer to either side of the property line that fifty (50) feet or the back property
line than fifty (50) feet." The Consenting Parties hereby authorize and consent that Section
III.A.(5) of the Declaration be amended to added the following sentence to end of Section
III.A.(5) of the Declaration:
"Notwithstanding the foregoing or as otherwise referenced in the plat of the
Subdivision, as to Lots Fifty-six (56) and Fifty-seven (57), Willow Run, Phase 3A,
Brazos County, according to plat thereof recorded in Volume 3244, Page 267 of
the Official Records of Brazos County, Texas or any future designation of such
lots, no building or structure except for fences may be located on these two (2)
parcels nearer to the front of the property line than one hundred (100) feet, or
nearer to either side of the property line that fifty (50) feet or the back property
line than fifty (50) feet."
3. Except as otherwise specifically set forth in this Amendment, the Declaration shall remain in
full force and effect. If there shall be any inconsistency between the Declaration and the
Amendment, the terms of this Amendment shall control. Upon execution and recordation of this
Amendment, the Declaration and this Amendment shall thereafter be referred to collectively as
the Declaration. This Assignment shall be binding upon and inure to the benefit of Subject Lot
Owner, the Lot 24 Owner and Owners of the Lots in the Subdivision described on Exhibit "A"
attached hereto and their respective heirs, successors, and assigns.
4. Subject Lot Owner, the Lot 24 Owner and Owners of the Lots in the Subdivision described
on Exhibit "A" attached hereto constitute a majority of the parcels in the Subdivision as
required by Section VI.2 of the Declaration for the approval of this Amendment.
