If it is determined that the prescribed erosion control measures are ineffective to retain all sediment on-site, it is the Contractor's responsibility to implement measures that will meet City, State, and Federal requirements. 7. All disturbed areas will be re-vegetated prior to Letter of Completion or Certificate of Occupancy. 8. All trees required to be protected as part of the landscape plan must be completely barricaded in accordance with the Landscaping and Tree Protection Section of the City's Unified Development Ordinance, prior to any operations of this permit. The cleaning of equipment or materials within the drip line of any tree or group of trees that are protected and required to remain is strictly prohibited. The disposal of any waste material such as, but not limited to, paint, oil, solvents, asphalt, concrete, mortar, or other harmful liquids or materials within the drip line of any tree required to remain is also prohibited. 9. All construction shall be in accordance with the stamped approved plans and specifications for the above-named project and all of the codes and ordinances of the City of College Station, as well as State and Federal Regulations that apply. Only those deviations from BCS Unified Design Guidelines, Specifications and Details specifically requested and approved will be allowed. 10. Special Conditions: TXDOT permit has not been approved, prcoeed at own risk. Landscape plans have not been approved, and needs to be address prior full building permit. Proposed median does not meet the TxDOT access management guidelines for a right-in / right-out only access point, the median needs to be more substantial so there is no question regarding the intended function of this access point, also required is a restriping eliminating the left turn lane assuring south bound traffic no option to left into property from George Bush Dr. Before access can be approved these revisions must be implemented into the property's proposed plan and commercial access request. We look forward to reviewing the revised proposal for access on the land use / access change. Response: The median has been modified to be more substantial to direct users in a manner that discourages left in/left out movements. Because of the limited throat depth available, we had to remove two existing parking spaces to modify the driveway median as shown. It was also our understanding in a previous meeting with TxDOT that they had agreed to restripe George Bush Drive as to not allow the left in movement. All construction of materials shall be subject to inspection and approval by the State. 3. Maintenance of facilities constructed hereunder shall be the responsibility of the Permittee, and the State reserves the right to require any changes, maintenance or repairs as may be necessary to provide protection of life or property on or adjacent to the highway. Changes in design will be made only with approval of the State. 4. The Permittee shall hold harmless the State and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exercise of this permit. 5. Except for regulatory and guide signs at county roads and city streets, the Permittee shall not erect any sign on or extending over any portion of the highway right of way, and vehicle service fixtures such as fuel pumps, vendor stands, or tanks and shall be located at least 12 feet from the right of way line to ensure that any vehicle services from these fixtures will be off the highway right of way. 6. The State reserves the right to require a new access driveway permit in the event of a material change in land use or change in driveway traffic volume or vehicle types. 7. This permit will become null and void if the above-referenced driveway facilities are not constructed within six (6) months from the issuance date of this permit. 8. The Permittee will contact the State's representative telephone, ( ) , at least twenty-four(24) hours prior to beginning the work authorized by this permit. 9.
