The City was undergoing a full scale revision to the UDO that was to become effective in 2005. This project was fully designed and under construction prior to the effective date of the 2005 UDO revisions (Construction of the entrance drive & utilities for Hilton Homewood Suites happened even prior to 2004). As demonstrated below, the Owner,Engineer,Architect, and City of College Station worked diligently to have this project submitted prior to the 2005 UDO changes. I believe the correct vesting date for the project is 2004.All construction that has occurred, has been with respect to the original UDO effective in 2004. It was apparent that the City was pleased with the design, concept and building characteristics. Any alternate design or construction methodology that was used is listed below: 1. 8" Sanitary Sewer Design Slope: 0.4% line slope was used instead of the 0.55% line slope indicated in the guidelines. This is necessary due to constraints of existing and previously designed infrastructure. To maintain adequate vertical separation from existing and previously designed infrastructure, the 0.4% slope has been implemented along the entire 783' run of pipe. This is the maximum pipe slope that can be achieved in the design while maintaining adequate vertical separation between the various water lines, electrical conduit, and storm sewer lines. The 0.4% line slope does adhere to the TCEQ minimum 8" line slope requirement of 0.33% as defined in TCEQ Design Criteria For Domestic Water Systems (Title 30, Partl, Chapter 217, Subchapter C, Rule 217.53) I also acknowledge,to the best of my knowledge,that the details provided in the construction plans are in accordance with the Bryan/College Station Standard Details. This letter specifically addresses Engineering Comments No. 2, Item#11 which states the following: "Please provide an explanation in the letter stating why the B/CS' guidelines for sewer slopes can't be met." Response: The proposed 8" PVC, SDR-26 sanitary sewer line slope of 0.4% is necessary due to the constraints of the proposed and existing infrastructure currently in place. In order to maintain adequate vertical separation,the 0.4% slope has been implemented along the entire 783' run of pipe. Despite the slope of 0.4% deviating from B/CS Unified Design Guidelines for Sanitary Sewer (2012), the 0.4% slope does adhere to the TCEQ minimum slope requirement of 0.33% as defined in TCEQ Design Criteria For Domestic Water Systems (Title 30, Part 1, Chapter 217, Subchapter C, Rule 217.53). The issue revolved around parking and NRA requirements that might alter the building design thereby causing him to be unable to meet the square footage requirements in the agreement(the least of his concerns in my opinion). What we are not okay with is expanding any sort of similar protection or expansion of the agreement onto the adjacent property that David owns. I am not certain of the best way to adjust the language of the current agreement to satisfy David's issue and would suggest we let Chuck propose some language that we can respond to. Chuck is seeking to amend the economic development agreement with Sahara Realty (David Scamardo) for University Town Center. David believes that the Council already indicated their agreement to his first request for an extension to perform the remaining two phases. David also thought that when Chuck previously proposed grandfathering the remainder of the development covered by the agreement, you had some concerns with doing so. Can you let me know what your thoughts are now so that I can respond to Chuck? To reiterate, before we had begun plans for the development of the last phases, David was concerned that the site plan was not vested. We approached Carla Robinson about an amendment to the Development Agreement and she recommended we talk to David Gwin, who got us with Bob. We expressed the need that the site plan be vested or we would not be able to build the project that was approved by the council. That is why the email specifically says the site plan is vested. As we have discussed previously, I have no problem acknowledging that the project (based on the limits described in the economic development agreement) is vested to the development ordinances in effect in 2005 and as such the site plan previously approved by the City for two phases consisting of 25,000 and 31,000 square feet is vested. As we have noted previously, any expansion of the project onto adjacent property would of course be required to comply with the ordinances in effect at the time of expansion. If you need something more formal than this e-mail please let me know. Also, if you have alternative language you would propose, please send it to me and I will take a look at it. I have completed my review of the project and your question regarding the status of the existing parking areas in University Town Center. While the site plans for the project have all expired and will need to be renewed and thus comply with applicable standards, the existing constructed parking lot is grandfathered, meaning that it will not be required to be altered (no change in landscaping, drive aisles, etc will be required) as the new phases are developed. This grandfathering avoids the need for any type of variance, PDD, etc. regarding the parking lot. I will follow this e-mail up with a written letter to this effect in the next few days, but I wanted to get this information to you as soon as possible to aid in your decision making regarding the current property and development of adjacent property. Cowell, Jr., AICP Director Planning &Development Services College Station, TX J MEMORANDUM PRIVILEGED AND CONFIDENTIAL TO: File FROM: Carla Robinson DATE: 05/13/11 RE: University Town Center EDA I met with David Neeley, David Gwin, and Jeff Kersten to talk about the EDA amendment that is being circulated for signatures. The amendment extends the time Scamardo has to perform until the expiration of the agreement in 2015. I explained that Scamardo has been in default under the agreement for a number of years. The council has at least twice given direction that they don't want to take any action on the default. A couple of months ago Chuck Ellison contacted me asking to amend the EDA to extend the time to perform and asking that the development be vested to the regulations in place when the EDA was entered into. We met along with Lance Simms and David Gwin. David said that the council had taken action back in 2009 to amend the agreement to extend the time for performance to 2015 contingent upon Scamardo signing but he had not yet signed. It was agreed that we would execute the amendment. Jeff pointed out that we had made the first two payments but have not made the last three since Scamardo was in default. With this amendment Scamardo would no longer be in default and the city would owe the remainder in 2016 in the event Scamardo performs. Also, Bob Cowell indicated that in his opinion as zoning administrator the development was already vested. Bob sent an email to Chuck Ellison stating that (we do not have a copy) and Chuck was satisfied that resolved the vesting issue. MEMORANDUM PRIVILEGED AND CONFIDENTIAL TO: File FROM: Carla Robinson DATE: 04/29/11 RE: University Town Center Development Agreement Met today with Chuck Ellison, David Scamardo, David Gwin, and Lance Simms. Chuck is concerned that the site plan that is part of the development agreement has expired and that the new UDO standards will now apply making it impossible for Scamardo to meet the square footage requirements in the development agreement. He is seeking an amendment to the agreement that will recognize that the project is vested. I told Chuck that I discussed this with Bob Cowell and Bob indicated that as zoning administrator he believed the project was vested. Bob thought that Scamardo was asking to extend the development agreement to adjacent property so that adjacent property would then be vested. Chuck said that they had asked for that at one time but were no longer seeking to extend the vesting to other property. Chuck said that he would be satisfied with a letter from the zoning administrator recognizing the grandfathered status of the site plan that is a part of the agreement. Lance is going to get with Bob to discuss and prepare a letter. I only have one comment that remains: 1) Provide building material percentages for each elevation of each building. Percentages were only provided for the north (front) elevations. From an overall look, it appears the rest of the building elevations should be fine but I need a table of material percentages for each elevation to verify that. For reference,the minimum brick/stone requirement for the side elevations (east/west) is reduced to 10%and there is not a brick/stone one the rear elevation.The maximum percentages of the other material types remains the same.
