According to the Unified Development Ordinance Section 12-3.18, the Administrator has the authority to authorize adjustment of up to ten percent (10%) from any numerical zoning standard set forth in the Unified Development Ordinance. To approve the application for an Administrative Adjustment, the Administrator shall make an affirmative finding that specific criteria, as outlined in Section 12-3.18.E of the Unified Development Ordinance, have been met. The Administrator has found that: Granting the adjustment will ensure the same general level of land use compatibility as the otherwise applicable standards because the increased building encroachment does not significantly alter the intensity of the land use; Granting the adjustment will not materially or adversely affect adjacent land uses or the physical character of uses in the immediate vicinity of the proposed development because the increased building encroachment does not significantly alter the character of the structure; and Granting the adjustment will be generally consistent with the purposes and intent of this UDO owing to the scale of the increase. The following is the preliminary list of items needed to complete the submittal. Please submit the following information so this application can be forwarded for review: Complete the application by clearly stating the requested administrative adjustment in question #1 on page 2 of the application and the section from which you are requesting to vary on the bottom of page 1. The request, as stated, is ambiguous and can have multiple meanings. A site plan if structure is proposed or survey if structure is completed should be submitted to show the proposed encroachment. As the owner of the property is a corporation, provide proof of authority for signing individual to sign on behalf of the corporation. Please be aware that if this application is not completed before Monday, February 16, 2015, it will expire and a new application and fees will be necessary to continue the Administrative Adjustment process. We are requesting a variance for a home to be built on this home site. This home site is smaller than the others in this section. Most of the home sites are 60x120 where as this one is smaller. The plan that we are proposing is the smallest plan that we offer. We do not have any other plans that could fit this site. This plan and home site are the only ones that fit this customers needs. As you will see in the attachment my home will exceeds the build line on the corner side by 1 foot 3 inches. Please let me know if you need any further information from me. Have a great afternoon.
