Boyett Estate Partition, Lots 1-8, Block 20 Dear Mr. Daily: This letter is to inform you that the above referenced property has received an administrative adjustment of 9.1% to the required 198 parking spaces being 18 parking spaces for the proposed 200 bedroom multi-family development as per Section 12-5.8.6.6 Off-Street Parking Spaces, of the Unified Development Ordinance. This section requires off-street parking facilities to meet 75% of the number of specified parking spaces required under Section 12-7.3.1 Number of Off-Street Parking Spaces, of the Unified Development Ordinance. Section 12-7.3.1 Number of Off-Street Parking Spaces requires 1.5 parking spaces for one bedroom units and 2.5 parking spaces for two bedroom units with bedrooms less than 130 square feet in area. This development has 56 one-bedroom units and 144 two- bedroom units with bedrooms less than 130 square feet. According to the Unified Development Ordinance Section 12-3.18, the Administrator has the authority to authorize adjustment of up to ten percent (10%) from any numerical zoning standard set forth in the Unified Development Ordinance. To approve the application for an Administrative Adjustment, the Administrator shall make an affirmative finding that specific criteria, as outlined in Section 12-3.18.E of the Unified Development Ordinance, have been met. The Administrator has found that: Granting the adjustment will ensure the same general level of land use compatibility as the otherwise applicable standards because the decreased requirement does not significantly alter the intensity of the land use, as the development will achieve compliance with the existing standards; Granting the adjustment will not materially or adversely affect adjacent land uses or the physical character of uses in the immediate vicinity of the proposed development because with the reduction in the required number of parking spaces, one bicycle parking space is provided per parking space taken away. Granting the adjustment will be generally consistent with the purposes and intent of this UDO as the reduction in the requirement is not significant in relation to the compliance otherwise achieved.
