I'm working with Lauren on the new Chimy's restaurant - previously Deluxe Diner. I just received an auto -response from her that she's out until the 20th. I have some questions/concerns that I need to discuss with you. Do you have some time soon to talk? We received 4 pages of comments back on the site plan and elevations. I've gone through each individual comment with my client. We believe we're able to address all but 3 items. Unfortunately, those 3 items are potential deal breakers. If we're not able to resolve these 3 items, he will pull the plug and walk away from the deal to redevelop the site. I really need your help to work through these issues. I've attached my list of questions/concerns that I put together for Lauren so you have more detail. Please let me know when you're available and I'll come to you. Thanks! It must be included in the new second story addition and be shown on the exterior elevation drawings. Sheet A1.2 shows the cooler to be 238 SF in area. This addition will cause the project change to exceed the 50% threshold identified in Section 9.3 of the Unified Development Ordinance. The bathroom being added for ADA purposes does not have to be included in the square footage of change. Please revise." The two walk-in coolers are mechanical equipment associated with the building similar to an A/C unit, trash compactor or dumpster. They are not an addition to the building and do not require a second story. As such, we can screen these similar to the dumpster enclosure with a CMU wall painted to match the building. Staff comment, "Two architectural relief elements and a public entrance are required on the fagade facing Patricia Street. The wood on this fagade also exceeds the maximum of 20%. We're ok with adding two architectural relief elements and modifying the wood on this fagade to less than 20%. However, the public entrance along Patricia cannot be accomplished given the existing configuration of the building including the location of the bathrooms, kitchen and the building's utilities. We are ok with having a public entrance on the west side of the building as an alternative. • Staff comment, "Transparency on the front fagade facing University Drive must be 50% and the Patricia Street fagade must be 30%." Since the building is existing, can we get some relief from this requirement? We may be able to meet this requirement on the University Drive side — we're still looking into the claculations. However, we cannot meet it on the Patricia side. Other Issues/Questions: Staff comment, "The second -story addition must be a functional space to meet qualifications. Due to the holidays, the Building division was not available to discuss the codes related to second story ingress and egress. However, it is anticipated that exterior ladder access will not be sufficient for a functioning second -story use. I will get back to you at a later time with more information. Also, please label the portion of the building that is intended to be two-story." I didn't hear back from Lauren. I'm happy to contact the building dept., 1 just didn't want to rehash something she had already discussed with them. Staff comment, "The property is shown by the Brazos County Appraisal District as being owned by Radakor, LLC. Please add their information to the site plan, or provide documentation showing the proof of sale." Do 1 just add this in the title block of the site plan? We have the property under contract and in that contract have the right to seek site plan approval. Staff comment, "Please provide documentation that confirms the intended use as being a restaurant and not a night club." What kind of documentation do you need? Here's what 1 included in our response, "Chimy's is a restaurant as stated on the site plan application. More specifically, Chimy's is a 'restaurant, fast food" as defined by the UDO, "An establishment that offers quick food which is accomplished through a limited menu of items already prepared and held for service, or prepared quickly. Orders are not generally taken at a customer's table and food is generally served in disposable wrapping or containers'.")
