Dear Commissioner,
We are submitting this request for a Sidewalk Variance from the Unified Development
Ordinance as described below:
UDO Article 8.2.13 Sidewalks
a. Sidewalks shall be required on both sides of all streets having a right-of-way
width equal to or greater than sixty feet (60'). Sidewalks shall be placed within
the right-of-way as determined by the City Engineer and when so specified.
Valley Park Center Site Information
a. Total Right-of-Way Length: 1975.78 feet
Requested Variance:
a. That no sidewalks will be required to be constructed as required by Article 8.2.13
Sidewalks in the UDO.
Existing and Proposed Property Characteristics
Valley Park Center is located at the Northwest corner of FM 2818 and Highway 60. The
property is bound by an undeveloped tract to the North,the new City of College Station
Cemetery to the West, and FM 2818 to the East. The FM 2818 R.O.W. is approximately
1975.78 feet in length.
Valley Park Center is being developed in three phases. Phase 1 was developed in 2006,
and consists of a 56,000s.f. building, parking lot, sidewalks, and landscaping located on
lot 1. Phase 2 is currently under construction, and it consists of a 25,000s.f. office
building, parking lot, sidewalks, landscaping, and utilities located on lot 2 and a portion
of lot 3. Phase 2 also includes the construction of the detention pond located on lot 4.
Phase 3 is currently in the planning stages to include a 45,000s.f. office building, parking
lot, sidewalks, and other necessary appurtenances to be located on part of lot 3 and lot 4.
The portion of the Valley Park Center that has already been constructed includes a
continuous five foot(5') pedestrian pathway. The pathway has been planned to be
continuous throughout the remainder of the subdivision.
Regarding the Variance request, explain how:
1) There are special circumstances or conditions affecting the land involved such
that strict application of the subdivision regulations will deprive the applicant of
the reasonable use of his land.
- Lots 1, 2, a portion of lot 3, and a portion of lot 4 have already been
developed or are currently under construction. This would impose a
significant expense on the already constructed development.
2) The waiver is necessary for the preservation and enjoyment of a substantial
property right of the applicant.
- The sidewalk ordinance at this stage of the Valley Park Center
Development would infringe on the right of the property owner to
continue existing land use and development intent. This intent has been
vested and established via the city site planning processes.
3) The granting of the waiver will not be detrimental to the public health, safety, or
welfare, or injurious to other property in the area, or to the City in administering
subdivision requirements.
- The granting of this variance will not have an adverse impact on health,
safety, or welfare considering that there is an existing pedestrian pathway
through the development.
- The adjacent property to the West has already been developed into the
new city cemetery. The sidewalk variance was granted to the new city
cemetery. There will be no subsequent injurious consequences to the
other properties in the area, or to the city in administering subdivision
requirements.
4) The granting of this waiver will not have the effect of preventing the orderly
subdivision of other land in the area in accordance with the provisions of the
UDO.
- The adjacent city cemetery property has already been developed without
sidewalks, and the property to the North has sought and received the same
sidewalk variance that we are seeking. The granting of this ordinance will
likely not prevent the orderly subdivision of other land in the area in
accordance with the provisions of the UDO.

Existing and Proposed Property Characteristics
Valley Park Center is located at the Northwest corner of FM 2818 and Highway 60. The
property is bound by an undeveloped tract to the North,the new City of College Station
Cemetery to the West, and FM 2818 to the East. The FM 2818 R.O.W. is approximately

The Valley Park Center development is being developed in three phases. Phase 1 was

Public access to the Valley Park Center subdivision consists of three TxDOT approved
entrances, one of which is located at Northeast corner of the Valley Park Center property.
This entrance also includes a joint access easement to provide public access to the
undeveloped property to the North of the VPC property. The second entrance is located
at the East corner of lot 1 and lot 2. The third entrance is located at the southern corner
of lot 4 via a short extension of the existing Highway 60 access road.
The TxDOT review emails are included as an attachment to this Variance Request to
provide historical evidence that the block length requirements of the C.S. U.D.O. were
not acceptable to TxDOT relating to this particular project.
Regarding the Variance request, explain how:
1) There are special circumstances or conditions affecting the land involved such

- Lots 1, 2, a portion of lot 3, and a portion of lot 4 have already been
developed or are currently under construction, which limits the land
resources available.
- The Valley Park Center Eastern boundary is adjacent to the FM 2818
R.O.W. TxDOT will not consider an additional intersection along this
boundary.
2) The waiver is necessary for the preservation and enjoyment of a substantial
property right of the applicant.
- The Valley Park Center Eastern boundary is adjacent to the FM 2818
R.O.W. TxDOT will not consider an additional intersection along this
boundary.
- The block length ordinance at this stage of the Valley Park Center
Development would infringe on the right of the property owner to
continue existing land use and development intent. This intent has been
vested well established via the site planning processes.
3) The granting of the waiver will not be detrimental to the public health, safety, or
welfare, or injurious to other property in the area, or to the City in administering
subdivision requirements.
- TxDOT has already limited access to FM 2818 to the existing two
entrances on lot 1 as well as the entrance off of the access road on lot 4.
The granting of this variance has the potential to benefit public health,
safety, or welfare.
- Pertaining to other property in the area: The block length variance will
not impact other property in the area as the property to the West of the
North/South property line is already designated to be a minor collector,
separating the already developed cemetery from the Valley Park Center
property.
- Based on existing lot development, and TxDOT regulations, this will not
have a negative affect for the City administering subdivision requirements.
4) The granting of this waiver will not have the effect of preventing the orderly
subdivision of other land in the area in accordance with UDO provisions.
- The adjacent property that has any bearing on this discussion has already
been developed. Likewise, the property to the East is TxDOT R.O.W., at
the intersection of FM 2818 and Highway 60, of which TxDOT will not
consider additional intersections at this location.

2) Minor extension of WFR(approx. 220') will be allowed to provide access
to Lot 4. Roadway section to be built to TxDOT specifications & will
be maintained by the City of College Station.
3) Access driveway will be allowed to Lot 1 from FM 2818 southbound
lanes prior to exit ramp taper. Access will be right-in, right-out & a
decal lane will probably be required.
4) Access to Lots 3 &4 may be provided by a cross-access easement or to
possibly a City required collector street along the west side of the
property.

Staff reviewed the above-mentioned final plat as requested. The following page is a list of staff
review comments detailing items that need to be addressed. If all comments have been

project will be placed on the next available Planning and Zoning Commission meeting

1. This plat cannot be forwarded to P&Z as proposed until the existing 20-ft. PUE is formally
abandoned thru council. However, if the easement was left on at this time it could be
forwarded to P&Z and once the abandonment are labeled with volume and page.
2. Please verify that all existing easements are labeled with volume and page.

3. All driveways for this development must meet minimum driveway spacing requirements for
this size thoroughfare and speed limit and must be approved by TxDOT.

4. Please provide a note on the plat to address maintenance and ownership of all private and/or
access easements.

ELECTRICAL COMMENTS REQUIRING IMMEDIATE ATTENTION
1. Developer provides temporary blanket easement for construction purposes or provides
descriptive easements for electric infrastructure as designed by CSU for electric lines.
- The temporary blanket easement is pending city.
2. Developer may be responsible for locating easements on site to insure that electrical
infrastructure is installed within easement boundaries.
- This is to be done at completion of construction.
GENERAL ELECTRICAL COMMENTS
- Developer installs conduit per CSU specs and design.
- CSU will provide drawings for electrical installation.
- Developer provides 30' of rigid or IMC conduit for riser poles. CSU installs riser.
- Developer will intercept existing conduit at designated transformers or other
existing devices and extend as required.

Valley Park Center: Sidewalk Ordinance Variance

1) There are special circumstances or conditions affecting the land involved such
that strict application of the subdivision regulations will deprive the applicant of
the reasonable use of his land.
- Lots 1, 2, a portion of lot 3, and a portion of lot 4 have already been
developed or are currently under construction.
2) The waiver is necessary for the preservation and enjoyment of a substantial
property right of the applicant.
- The block length ordinance at this stage of the Valley Park Center
Development would infringe on the right of the property owner to
continue existing land use and development intent. This intent has been
vested and established via the city site planning processes.
3) The granting of the waiver will not be detrimental to the public health, safety, or
welfare, or injurious to other property in the area, or to the City in administering
subdivision requirements.
- The granting of this variance will not have an adverse impact on health,
safety, or welfare.
- The adjacent property to the west has already been developed into the new
city cemetery. The sidewalk variance was granted to the new city
cemetery. There will be no subsequent injurious consequences to the
other properties in the area, or to the city in administering subdivision
requirements.
4) The granting of this waiver will not have the effect of preventing the orderly
subdivision of other land in the area in accordance with the provisions of the
UDO.
- The adjacent property that has any bearing on this discussion has already
been developed. Likewise, the property to the east is TxDOT ROW, at the

Dear Christina,
After reviewing the Unified Development Ordinance, accessory uses such as parking are allowed as long
as they are located in the same or more intense zoning district. The proposed site for Valley Park would
require parking for a C-1 use to be located both within C-1 and C-2 zoning districts. When evaluating the
uses allowed in C-2, Commercial-Industrial compared to C-1, General Commercial, we have found that
parking for the C-1 use may be located in the C-2 portion of the property.

Attached are the pages. Be careful with the warehouse numbers, because as that office building is flex
between warehouse and office, unless you're going to nail down a specific square footage to be used for
warehouse and plan the site plan accordingly, the building can be all office per the zoning and needs to be
assessed as such for the TIA.
Also, as an FYI, if you're submitting the site plans in the next 3 weeks, I won't be here to review, but I've put all
the notes on this in the file for the replat so there's record of it with this case.
