ADMINISTRATIVE ADJUSTMENT REQUEST
The following specific adjustment (up to 10%)from the ordinance requirements is requested:
Adjust ordinance requirement to allow for residence's encroachment into 25'front setbacks. One small portion of
residence encroaches into setback 0.7 feet-see survey attached as Exhibit A.
This adjustment will not be contrary to the public interest by virtue of the following facts:Condition has existed for
25 years without harm to public or neighbors. Only a small part of the building encroaches into the setback and the
encroachment is less than 3 percent of the minimum setback. Because property lies on cul-du-sac and on a wedge-shaped
lot, the encroachment is not apparent.
The granting of the adjustment will not materially or adversely affect adjacent land uses or the physical
character of the uses in the immediate vicinity because of the following:Adjacent landowners acquired their properties
with this condition in existence. Property lies at end of cul-du-sac(see map attached as Exhibit B) and does not impact
views from adjacent lots.
The granting of the adjustment will be consistent with the purpose and intent of the Unified Development
Ordinance because of the following:Section 5.2 allows reduction of the minimum front setback to 15 feet when side
yard parking is provided. The property has a long drive constructed with extra spaces for parking -see attached survey.
In addition, the adjustment(a) promotes the beneficial interest of the owners of the property by promoting ease of
transferability(Section 1.3A, UDO), (b) protects the character and condition of the existing building on the property and the
existing neighborhood (Section 1.3B, UDO), and (c)does not create any conflict or discrepancy with the existing land uses
or character of the neighborhood in which the property is located (Section 1.3C, UDO).
The applicant has prepared this application and certifies that the facts stated herein and exhibits attached
hereto are true, correct and complete.
