Ross' Cc: Barry Sherman; Michael Bray Subject:ADT Self Storage-Plat Comments Stephan, A new issue has come up with the College Station project that will require your involvement. See the attached exhibit. The city has just decided they need a 120'right-of-way dedication as opposed to the 100'originally agreed upon. After review,we've determined the result shouldn't have any effect on the building footprints, and will require only minimal site plan adjustments along the right-of-way. Also,since the current thoroughfare plan for this area only allows the city 100'of dedication,you could require them to purchase the additional dedication area. When calculated,the area of additional dedication turns out to be a—15 ft.x "421 ft.strip of land,or"6,300 sf. It's our understanding that since the property was recently purchased,the city may use those numbers to help appraise the value of the additional dedication. The caveat going this route is that the additional documentation and purchase agreements required by the city will likely result in delaying the current Nov. 13 final plat approval date; possibly up to 3-5 weeks. Another option would be to grant the additional dedication to the city at no cost, allowing us to maintain our current schedule. If pursuing this route, it wouldn't hurt to see if the city would be willing to negotiate other issues with you to help lower construction costs. For example,you could request the zoning review board grant a variance to eliminate the 10'sidewalk they are requiring along the south façade of Building A. In conclusion, it seems we need to determine whether the appraisal value for the dedicated strip of land would be worth delaying the start of construction 3-5 weeks.You should contact Mark McAuliffe, land agent with the City of College Station,at 979-764-6272 to initiate the process and verify how the appraisal will be determined. Also, Barry Sherman will be in contact with you to discuss some options. If I can shed any further light on the subject, please don't hesitate to call. October 20, 2008 ■ Suite 105 Matt Robinson 111 University Drive East City of College Station College Station,Texas 1 101 Texas Ave S. 77840 College Station, TX 77840 RE: CUTTING EDGE ADDITION SIDEWALK VARIANCE Matt, The owner of the Cutting Edge Addition is requesting a variance to subdivision regulation Chapter 9, Section 8-M.1 which would allow the elimination the requirement for construction of a sidewalk in the right of way of Rock Prairie Road. The owner is requesting this variance as a special condition since the design of improvements which include the construction of future sidewalks along Rock Prairie Road are currently in process. It is our understanding that this design is not yet complete and the ultimate section for Rock Prairie Road is not final. Therefore, the construction of the sidewalk improvement at this time may be in conflict with the ultimate design currently under way. The owner is however dedicating property to the City for the ultimate right of way for Rock Prairie Road.
