KNOW ALL MEN BY THESE PRESENTS: `
COUNTY OF BRAZOS )
THAT, GRACE H. MARSH, JOHN EMORY MARSH, JR. , ROBERT E. REEVES,
MARSHA R. DUEMKE, and LOUISE MARSH REEVES, Individually and as
Trustee, GRANTORS, for and in consideration of the
and NO/100 DOLLARS, cash, and other good and valuable payment of considera-

in hand paid to GRANTORS by the CITY OF COLLEGE STATION,
TEXAS, the receipt of which is hereby acknowledged, have GRANTED,
SOLD and CONVEYED and by these presents do GRANT, SELL, and CON-

VEY unto the said CITY OF COLLEGE STATION, a Texas Municipal
Corporation, certain rights and interests in the nature of a per-
( petual EASEMENT on and through the following described property:
Being a strip of land in the Robert Stevenson League
in Brazos County, Texas, twenty feet (20 ' ) in width
through that 111 .6 acre tract described in deed to
Louise M. Reeves, Trustee, recorded in Volume 509,
Page 185, of the Deed Records of Brazos County,
Texas.
Provided, however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and cen-
terline on the attached Exhibit "A" , known as the "Easement
Area" , and any additional area ou 'de the easement area neces-
sary to install and attach Q' , guy wires, and anchors nec-
essary and incident to the uses of the Easement Area.
To erect, construct, install , and thereafter use, operate, in-
spect, repair, maintain, reconstruct, modify, and remove the
following:
Electric transmission and distribution lines;
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of GRANTORS, which
might interfere with or threaten the operation and maintenance of

any public utility equipment, accessories, or operations. It is
understood and agreed that any and all equipment and facilities
placed upon said property shall remain the property of GRANTEE.
GRANTORS expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and agree to sublender' s subordinations on behalf of
GRANTEE upon request.
It is expressly understood that the GRANTORS or future Owners of
this property reserve the right to use this EASEMENT for all
purposes which do not interfere with or prevent its use by the
GRANTEE, including without limitation, the use and construction
of streets, roadways, driveways, alleys, parking lots, paving,
curbs, lawns, and other like uses, on, over, and across this
easement. GRANTEE shall replace and restore any damage done by
the GRANTEE to the above described items constructed or used by

the GRANTORS. Also, this easement may be used by the GRANTORS or
future owners of this property as a "Greenbelt" strip to comply
with the City ordinances for such "Greenbelts. "
GRANTEE shall have the right to use so much of the surface of the
hereinbefore-described property of GRANTORS as may be reasonably
• necessary to construct and install within the right-of-way
granted hereby the facilities contemplated by this grant. Upon
the completion of such construction and installation, GRANTEE
shall replace and restore all fences, walls, or other structures
which may have been relocated or removed during the construction
period, and GRANTEE shall pay GRANTORS reasonable compensation
for such fences, walls, or structures which may not be replace-
able, and for such vegetation and crops and other damages to the
property as may have been damaged or destroyed during such con-
struction.
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its successors and
assigns, forever, and GRANTORS do hereby bind themselves, their
successors and assigns, to warrant and forever defend , all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or to claim same, or any
part thereof.

THAT the undersigned, of the County of Brazos and
State of Texas, the present legal and equitable owner and holder
of that one certain promissory note in the original principal sum
;, of $ 76, 000.00 , dated February 5 , 19$2, executed by
Louise M. Reeves. Trustee (Marsh-Reeves Trust) , payable
to the order of GRACE H. MARSH, more fully described in a Deed of
Trust, duly recorded in Volume 52f, Page mc..., of the Deed Records
of Brazos County, Texas; said note being secured by said Deed of
Trust against, AMONG OTHER PROPERTY, the property as described on
Exhibit "A" attached hereto which is incorporated herein for all
purposes.
For a good and valuable consideration paid to the •
undersigned, the receipt and sufficiency of which is hereby
I acknowledged, the undersigned hereby EXPRESSLY SUBORDINATES the
above-described lien to the easement and right-of-way heretofore
or contemporaneously granted to the City of College Station by a
document executed by Grace H. Marsh, John Emory Marsh, Jr. ,
Robert E. Reeves, Marsha R. Duemke, and Louise Marsh Reeves, and
I recorded in the Deed Records of Brazos County, Texas.
It is expressly agreed and understood that this SUBOR-
DINATION shall in no wise release, affect or impair said lien or
liens against any other property or owner of any interest there-
in, nor shall the priority of said lien or liens be affected
