Apparently District wants the Owner to mark the ROW in this area. Thinking it might be almost impossible in this location I contacted Kling Engineering (local survey gurus in B/CS since 1948)for their thoughts & they indicated it was very doable. I don't know anything about the ROW in this area and really don't know for sure about the other. I am not comfortable with this proposal. If they want that to know whether they can do this, they should have their surveyor survey and label the actual ROW line on their site layout. It appears that the current drawing shows this landscaping to be outside their property. Additionally, I can't tell whether it would meet ADA/TDLR requirements. The driveway issue appears moot. I can ask College Station to try & get a TxDOT name on the ROW question, but it'll probably be "I don't remember". Also, Maury seems to be happy with the 2 trees & 2 benches ; and the existing access drive is going away. I can send them Maury's comments & let it go at that. Any comments ?? However, the ROW is so vague in this area that I don't know if anyone knows where it is. Has anyone in your area talked to the Owner. Also, they are proposing esthetic improvements ?? Should we care?? I have also attached an aerial to give a better idea where this site is. On a positive note they are closing an existing access so the landscape appears to be a better trade-off even if we knew where the ROW is. The new issue is that the owner of Schotzi's is claiming that he talked to someone at TxDOT and was told that the little area southwest of the parallel parking is not TxDOT right-of-way. I would just like to clarify, because it appears to me that this little area is TxDOT right-of-way.
