Lloyd to Wellborn Water Supply Corporation dated October 6, 1965, and recorded in Volume 254,Page 323,Deed Records of Brazos County,Texas. One or more water lines were placed upon the property made the subject of such easement. The easement itself contains language which indicates as follows. "... that when a pipeline is installed, the easement granted shall be limited to a strip of land twenty(20)feet in width with the center line thereof being the pipeline so installed" Thus,in effect,the general easement is already defined and does not affect the remainder of the property. If dispositive of this problem, Wellborn SUI)will provide a release or disclaimer as to any right to utilize the old easement for any other or additional line or lines. Wellborn SUD stands ready to release the blanket or general easement and to substitute in its place a specific field note described easement of 20 feet in width covering the line(s)in place on your property for any and all such lines that must be continued in use for its service to this and other properties. It will be necessary for you to work with Wellborn SUD to identify all such lines and to engage an engineering firm to provide the needed field note descriptions and for you to execute a specific easement in replacement of such general or blanket easement. Given the City of College Station's requirement that they must enjoy"first rights" to any Public Utility Easement(PUE)which is dedicated on a plat of your new subdivision,Wellborn SUD will not be able to completely depend upon such PUE for any line easement route unless a very specific written grant is provided by the City. It may,therefore,be necessary for you to include a PUP for Wellborn's line or lines along side that of the plat which is prioritized to the City. This seems like an inexplicable "catch 22"that should be resolved with the City's cooperation and we hope that it will P.O. Box 9960 ) College Station, Texas 77842 Re.: University Preserve Subdivision Street Maintenance Funds ABET No. 1042001 Dear Natalie: At the request of Mr. Deason, I am writing you this letter regarding the street maintenance funds for the above referenced subdivision. After speaking with street superintendents from the City of College Station and the City of Huntsville, it has been determined that annual costs of maintaining-, streets ranges from $719 to$386 per lane-mile, respectively. A lane-mile is a 12'wide travel lane for a distance of 5,280 feet. Since these numbers are based upon large quantities of streets being maintained, a factor of 10 will be applied to the calculated annual maintenance costs to adjust for the minimal quantity of lane-miles within this subdivision. Therefore, the total lane-miles within the University Preserve Subdivision is approximately 0.36 lane-miles. The projected maintenance fund needed to maintain the streets within this subdivision for a two year period (i.e. based on the College Station maintenance costs) is approximately $5,176.00.
