HomeMy WebLinkAboutVariance Request INDIAN LAKES PHASE 1 LOTS 9A/9B, BLOCK 2 & LOT 1R, BLOCK 12—FINAL PLAT VARIANCE REQUEST The Applicant is requesting a Variance consideration for the following item: Drawing Scale According to the Subdivision Regulations (Chapter 9, Section 6-D.4, Form and Content), Final Plats shall be submitted at a minimum scale of 100 feet to one inch (1" = 100'). The Applicant is requesting a variance to this requirement. This Final Plat has been submitted at a scale of 200 feet to one inch (1" = 200', Response to Subdivision Regulations, Section 5,Variances: The Applicant is submitting this Variance Request for convenience purposes. If this Final Plat were submitted at the required scale (1" = 100') the plat would cover four separate pages. It is the opinion of the Applicant that the plat would be easier to review and understand if it were contained on one sheet. All notes, dimensions, and other required information is clearly legible at the scale submitted. O rq(.0 _ W ICS pcicoPage 1of1 AMIN T-TACNinENT A INDIAN LAKES PHASE 1, BLK 2, LOTS 9-A&9-B—REPLAT VARIANCE REQUEST The Applicant is requesting a Variance consideration for the following item: Lot Width According to the Subdivision Regulations (Chapter 9, Section 13-C, Lot Width), subdivisions in the ETJ are required to provide for lot widths of at least 100 linear feet. The Applicant is requesting a Variance to the Subdivision Regulations to allow for a 78 linear foot right-of-way frontage on Lot 9-A, Block 2 and a 71 linear foot right-of-way frontage on Lot 9-B, Block 2. The Applicant would like to note that the proposed lot frontages meet the minimum 70 linear feet requirement established by the Brazos County Subdivision Regulations. No Variance for lot width is required by Brazos County. Response to Subdivision Regulations, Section 5,Variances: 5-A.1: The Applicant is requesting the lot width variance in order to adequately accommodate the following. Existing Platted Conditions— The Applicant is proposing to replat the existing Lot 9, Block 2 (17.38 acres) and HOA Lot 1, block 12 (62.28 acres) into three lots. One lot would include 6.50 acres. one would include 13.38 acres. and the HOA lot would be reduced to 59.78 acres. The only access available to the proposed Lots 9-A and 9-B abuts Arapaho Ridge Drive where just 149 linear feet of right-of-way frontage currently exists In order to accommodate the College Station Subdivision Regulations the two lots would require 200 linear feet of right-of-way frontage along Arapaho Ridge Drive. It would be impossible to create the necessary frontage without impacting the existing platted conditions of the surrounding lots that are not owned by the Applicant. 5-A.2. The Applicant believes that this replat meets all the requirements and intentions of the Subdivision Regulations. The proposed lot frontages meet the regulations of Brazos County, which is the entity that holds ownership and maintenance responsibilities of the roadway to which the lots will obtain access. This lot configuration is the most suitable for meeting the needs of the Applicant while satisfying all the regulatory restrictions imposed on the property, with the exception of the lot width requirement. 5-A.3: There is no reason to believe that the proposed lot configuration will create hardship on any party. The proposed lots are considerably large and will not create an unreasonable increase in traffic or other impacts to the roadways or adjacent property owners. 5-A.4 The proposed development "will not have the effect of preventing the orderly subdivision of land in the area" primarily due to its location within a parent tract that has been previously subdivided into a land use type complimentary to the proposed lot configuration.
