A conditional Council approval would give them more comfort I'm sure, but since we are already willing to issue Site Plan and
Building Permits I'm not sure it would effect the construction timing. Again, note that I don't think we should issue Site Plan or
Building Permits until after the utility is relocated regardless of a conditional Council approval of the abandonment.

Alan, If the abandonment is submitted to Council as a conditional abandonment conditioned on acceptance of the infrastructure
and dedication of a new easement, would that make a difference in the school's timing?

Carla,
I have added the bold comments to Mike Gentry's notes below. I'm not sure of the origin of the discussion on electric
easements - Carol is discussing with Tony.
1. The District will submit two applications to abandon easements.
a. The unrecorded sewer easement; and
b. The platted PUE.
2. The City should approve those applications since the City already has a Blanket Utility Easement in place,
Applications for abandonment are forwarded to Council after the subject utilities are relocated out of subject
easements to be abandoned - and constructed and accepted in the realigned location. Note that though Council
has consistently approved abandonments, their consideration is discretionary.
3. The City will permit the District to proceed with construction even if one or both of the applications to abandon
easements is delayed in processing. Typically the City does not approve Site Plans or issue Building Permits where a
proposed building encroaches upon easements (even if they are pending to be abandoned). In this instance, the

City is willing to approve the Site Plan and issue Building Permits after the utility is relocated out of subject
easements to be abandoned - and constructed and accepted in the realigned location, noting that it is the
applicant's risk to proceed ahead of abandonment(s).
4. After construction is complete, the District will apply to abandon the blanket utility easement and replace it with
specific as built easements. Easements must be dedicated and accepted before the blanket easement is released.
