HomeMy WebLinkAboutVariance Request Saddle Creek Subdivision — Phase 2 Final Plat Justification for Variance Section 8.K.1 -Lots This section requires side lot lines which make acute angles with front lines shall be avoided where practical. In general, an arrangement placing adjacent lots at right angles to each other shall be avoided. The Developer requests a variance to this requirement for Block 3,Lots 38, 39 &40. A.1 That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; The special circumstances are: Block 3 Prairie Dawn Trail/Wild Rose Court—This section of the Subdivision Ordinance is more relevant to urban single-family residential development,not rural 1-acre minimum lot size subdivisions like Saddle Creek. Exhibits A&B show the original layout submitted for Block 3 of Phase 2. The original layout included an additional lot. The Developer determined that Lots 38 & 39 would require that some of the wooded areas on these lots be cleared in order to build the homes. Because of this,he is proposing the lot layout shown on Exhibits C&D. As shown on these exhibits,the wooded areas at the rear of Lots 38 & 39, which is also an existing drainage channel,can be left as a buffer between Lots 38 & 39 and Lot 40. In this proposed scenario, the homes on Lots 38 &39 will be 300' from the home on Lot 40,whereas in the original layout,the distance between the homes on Lots 38 & 39 would be less than 100'. A.2 That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; In order to develop the Subdivision as planned this variance is necessary and the Developer prefers as much wooded area to remain as possible on these lots. A.3 That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; Granting this variance should not have any effect on the public health, safety, or welfare, or injurious to other property in the area since the lots comply with all other ordinance requirements. A.4 That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. The 3 lots involved with this variance request are surrounded by Phase 1 and other portions of Phase 2 of this same subdivision. All of the land adjacent to these 3 lots will be developed when the Phase 2 plat is filed. Because of this, this variance will not have the effect of preventing the orderly subdivision of other land in the area.
