Dear Mr. Robinson:
As per I telephone conversation of 17 March 2008, I would like to, as a home owner
within 200 feet of the referenced property, inform you that I have no objection to the
request made by the land owner in Project Number 07-005-0035.
However, I am opposed to the requested variance referenced above. I oppose it on the
grounds that it would set a bad precedent. It would be especially bad in this Historic
Neighborhood.
I am a firm believer in Private Property Rights,just as long as they are exercised in such
a manner that they do no harm to surrounding properties. This Variance, if granted would
be detrimental to the neighborhood in the precedent that it would set. I therefore,ask that
it be denied.
I thank you in advance for presenting my comments regarding these matters to the
Zoning Board of Adjustment in their meeting on 1 April 2008.

Dear Mr. Robinson,
I will be out of state on April 1,2008 and consequently will not be able to attend the public
hearing regarding a variance to the setback requirements for the property located at 101 Fairview
Avenue. I request that this letter be included in the packet provided to the ZBA members or be
read into the record which ever is appropriate.
I am opposed to the granting of the requested variance. The structure in question is old and in
poor physical condition and has modest value in its present condition. It is on the Brazos County
tax rolls for$41,000 which I think is high given the condition of the structure. The structure has
been vacant for some time and no exterior maintenance has been done to the structure for several
years. It is an eyesore. The structure has almost zero setback from George Bush Drive. The
structure should have been condemned and removed by the City of College Station when George
Bush Drive was constructed in the 1960s. In my opinion,if the ZBA grants the requested
variance,their decision would allow an earlier mistake to continue for a few more decades and
would not be in the public interest. This is a relatively busy intersection and the lack of any
setback on the George Bush Drive restricts the site lines normally provided by the setback
requirements.
If the owner of this property believes that the structure is worth salvaging,there is adequate room
to relocate the structure on the lot so as to comply with residential setback requirements.
Based on the drawing provided, it is clear that the owner's intention for this property and the
adjacent property is to develop it as two multi-person residences, small dormitories, as has been
done with several other properties in the Southside area while still complying with the ordinance
requirements for a single-family residence. I am not opposed to this use of the property but I do
not think a variance to support a business purpose is necessary or desirable. If this were
someone's homestead, which it is not, I would have some empathy for the home owner but I
would still be opposed to granting the requested variance.

SUBJECT: 101 & 103 FAIRVIEW & 503 OLD JERSEY (VAR —Variance Request)
Staff reviewed the above-mentioned variance application as requested. The following
page is a list of staff review comments detailing items that need to be addressed.
Please address all comments and submit the following information by Monday,
February 4th, 10:00 a.m., for your project to be placed on the next available Zoning
Board of Adjustment (ZBA) meeting scheduled for Tuesday, March 4th, 6:00 p.m. in the
City Hall Council Chambers, 1101 Texas Avenue.
The agenda and staff report for your project can be accessed at the following web site
on Friday the week before the ZBA meeting.
