July 26, 2007 Regular Agenda Lodge Street - Right of Way Abandonment To: Glenn Brown, City Manager From: Mark Smith, Director of Public Works Agenda Caption: Public hearing, presentation, possible action, and discussion regarding an ordinance vacating and abandoning a 5029 square foot portion of the Public Right of Way of Lodge Street, in the City of College Station. Recommendation(s): Staff recommends approval of the Application for Abandonment of the portion of the easement. Summary: The Right of Way proposed to be abandoned is a 5029 square foot portion of a thirty (30) foot wide Public Right of Way, which is located between Church Avenue and Patricia Street. A Public Utility Easement is proposed to be retained for the entirety of subject 5029 square foot area as public and private utilities exist within this reach. A Public Access Easement is also to be retained to continue to provide needed public emergency access. A&M United Methodist Church owns the properties on both sides of the proposed abandonment. The church has interest in abandoning the subject Right of Way to open the possibility of gating this portion of Lodge Street for the safety of their school children frequently traveling across the roadway between buildings. Retaining the subject easements as mentioned will allow the utilities to be maintained and accessed, and a knox box can be placed on the gate to allow public emergency access. Note that installation of a gate or other modifications will require plans to be submitted for permits should this abandonment be approved. Budget & Financial Summary: N/A Attachments: 1.
