RE: Relocating an easement for Fish Daddy's restaurant in College Station,Texas
Dear Frank,
I'm representing John Welsh, who is developing a new seafood restaurant in the Gateway Center
where Rockfish was previously located. The building that housed Rockfish has been demolished
and Mr. Welsh is currently working towards constructing a new building. The proposed building
for Fish.Daddy's creates a conflict with an existing utility easement on the property. To resolve
this issue, we are relocating the easement to the rear of the property. Technically we have to
abandon a portion of the existing easement and dedicate a new easement.
We've prepared the necessary paperwork through the City of College Station and worked with
local utility companies to ensure that relocating the easement will not impact adjacent property
owners. The easement is wholly contained within Mr. Welsh's property which is Lot 5A, Block
1 of the Gateway Subdivision, Phase 1. As part of the abandonment process to release the old
easement, the City of College Station requests that we contact abutting property owners to make
them aware of our proposal and ask you to sign the abandonment application. Attached is a copy
of an "Abandonment of Easement" application from the City of College Station that we would
like for you to sign agreeing to release a portion of the existing easement. In exchange we are
ro
proposing to dedicate a new easement along the rear of thec' �
property to cover new electrical lines.
Again, the easement is currently located and will remain completely on Mr. Welsh's property.

Dear Bridgette,
Attached is an application to dedicate a new 20' public utility easement for Fish Daddy's. This
easement will replace the easement that we have requested to abandon. As you'll recall, we
dedicated a temporary blanket easement to facilitate the issuance of the building permit. The
easement that we have requested to abandon encroaches into the new building. Utilities from
that easement are being relocated into this proposed easement.
We submitted the application to abandon the existing easement on May 7, 2007. Carol Cotter
later called me to let me know the application had changed and additional information is
required. The following information is included and should complete the request for
abandonment:
➢ Signature page from BTU. Randy Trimble with BTU abstained from approving or
denying the request since BTU has no facilities in this area and Fish Daddy's is not
within their service territory.
➢ All information required on the Easement Dedication Sheet. Since we are dedicating
the new easement, we went ahead and submitted the required information with that
application. The only piece missing is the final plat of the property. I pulled the plat up
on GIS and it was the wrong property.
You should have everything necessary to abandon the old easement and dedicate the new
easement. We would like to be scheduled for City Council as soon as possible to get these issues
resolved prior to completion of the building. Please let me know if you have any questions or
