SUBJECT: CHAMPION CREEK VARIANCE REQUEST
The owners/developers of the proposed office development on Reserve 1, Block
1 , Raintree Subdivision have requested height variances for the setbacks of the
buildings currently proposed for 2423, 2425, and 2427 Earl Rudder Freeway
South (referenced as Buildings 2, 3, and 4 on the attached exhibits).
The variance requests were tabled at the ZBA meeting on April 24, 2007. Since
that meeting the owners of the Champion Creek office development have met
with the abutting single-family home owners and the Raintree Homeowners
Association President to discuss fencing options that may mitigate the impact
height variances may have. The fence discussed between the property owners
is described on the attached "Letter of Agreement" and on the proposed motion.
At the last meeting, Board members questioned how a variance motion might be
stated to guarantee the execution of a mitigation effort (such as a fence).
Members also asked City staff to look into how a variance motion might be tied to
specific physical characteristics. Staff has provided a proposed positive motion
form that the Board may use in their consideration of the requested variances.
Through the proposed form, Staff references exhibits that would become part of
the motion. The motion is stated to allow variances only when all physical
conditions are met, including the size, style, and location of the buffer wall; the
location and size of the building footprints; the maximum roof slope of the
buildings; the maximum eaves height; the maximum finish floor elevation; and
the maximum height of any windows facing the shared property line.
Since the last meeting, there have been two phone calls inquiring about the
variance request.

FORMAT FOR POSITIVE MOTION
VARIANCE FROM SECTION 7.1.H Height of the Unified Development Ordinance.
I move to authorize a variance to the

from the terms of this Ordinance as it will not be contrary to the public interest, due to the
following special conditions:
The natural topography of the land and the regrading of the site necessary to protect the
single family homes from storm water runoff, together with the location of the site
against single family homes:
and because a strict enforcement of the provisions of the Ordinance would result in
unnecessary hardship to this applicant being:
An inability to create an office campus designed to be low-impact against the residential
and such that the spirit of this Ordinance shall be observed and substantial justice
done subject to the following limitations:
1. The property owner shall erect and maintain a precast concrete stone textured fence
along the eastern property line that is shared with single-family residences. The fence
shall begin between 9 and 10 feet in height at the northeast corner of the site and shall
gradually slope to a minimum of 8 feet in height at the southeast property corner, so
that the fence is consistently level. The fence will transition into the existing fence
around the north corner.
2. Buildings 2 and 3, as referenced in Exhibit 1:
■ shall not exceed 4,250 square feet each as reflected in Exhibit 1;
• shall be located no closer than 15 feet from the eastern property line shared
with single family residences as reflected in Exhibit 1;
• shall be constructed at a maximum average height between the eaves and
ridge lines of 18 feet or less as reflected in Exhibit 2;
• shall be constructed at a finished floor of 93 or less as reflected in Exhibit 1;
• shall have a roof pitch of 6:12 as reflected in Exhibit 2;
• shall have an eaves height no greater than 12 feet as reflected in Exhibit 2; and
• shall not locate any portion of a window or other glazing material above 8 feet
from the finished floor as reflected in Exhibit 2.
3. Building 4, as referenced in Exhibit 1:
• shall not exceed 4,250 square feet as reflected in Exhibit 1.
• shall be located no closer than 29 feet from the eastern property line shared
with single family residences as reflected in Exhibit 1;
• shall be constructed at a finished floor of 93.25 or less as reflected in Exhibit
1
• shall have a roof pitch of 6:12 as reflected in Exhibit 2;
• shall have an eaves height no greater than 12 feet as reflected in Exhibit 2; and
• shall not locate any portion of a window or other glazing material above 8 feet
from the finished floor as reflected in Exhibit 2.
These requirements satisfy the intent of the Ordinance to protect single family residential
against new conditions which would adversely affect that use. As such, these limitations
are related to the land and would create an aesthetically pleasing environment for the
neighboring single family properties in addition to lessening the impact of the proposed
office complex on the adjacent neighborhood.
These conditions being met, Building 2 is hereby granted a height variance of 14.5 feet,
Building 3 is granted a height variance of 12.5 feet, and Building 4 is granted a height
variance of 4.5 feet.
