Re: NTB Buffer Appeal
Dear Crissy,
As you are aware per Section 7.6.F Minimum Buffer Standards, given that we are a
commercially zoned property (C-1) adjacent to an (R-1) piece of property;
(1) We are required to have a 15 foot buffer with a wall,
(2) We can substitute a solid plant or hedge wall that is greater than 6 feet in height
with 100 percent opacity. It must be evergreen and may not be counted toward
meeting the buffer planting requirements,
or
(3) Walls and fences may be omitted if the required buffer yard plantings are tripled.
In addition to this, we are required to have the following plantings. We are required to
install one — 1 .25 inch caliper non-canopy tree per 15 linear feet of landscaping buffer and
one — 2 inch caliper canopy tree per 25 linear feet of landscape buffer
We are requesting a waiver to the above requirements on the following basis:
• The property adjacent to us that is zoned R-1 is not intended for use as single family
per the land use plan
• The R-1 property is currently encumbered with floodplain and wetlands areas so it
is extremely difficult to reclaim and build on.
• We originally requested that this R-1 property be rezoned to A-0 in our original
rezoning request in September 2005 (Case File # 05-00500160). We were told by
City Staff on 9/12/05 to "Amend proposed A-0 zoning configuration to be 5.0
acres, or staff will support retaining the R-1 zoning that exists. The area is not
indicated as a need on the Greenways Priority Map or to have any requirements
associated with the Bikeway and Pedestrian Master Plan". We disagreed with this
decision because the portion we were trying to rezone to A-0 would never be
developed as R-1 . The R-1 zoning that Staff told us to keep has now forced us to
comply with ordinance requirements which are much more cumbersome than the
A-0 requirements.

• We believe the floodplain and wetland areas that encumber the property and make
it extremely difficult economically to reclaim are special circumstances that warrant
this waiver.
• Had we been successful in our A-0 zoning request we would not have been subject
to planting:
- 161 - Burford Holly - Shrubs
- 78 - Southern Waxmyrtles - Non-Canopy Trees
- 1 - Chinese Pistache - Canopy Tree
- 3 - Southern Live Oak - Canopy Tree
- 7 - Cedar Elm - Canopy Tree
- 8 - Bald Cypress — Canopy Tree
(We have attached a window snapshot of the Landscape Plan already submitted to
the City.)
• This buffer ordinance was originally written to protect residential properties from
the impacts of commercial projects. This situation will never occur on this property.
