The application did not address if there are existing deed restrictions on this property. Please provide this information. Response: The deed restrictions were submitted on Nov. 28, 2006 via e-mail. 2. Provide tax certificates. Response: The tax certificate was submitted on Nov. 22, 2006. 3. Provide a note stating that the extension of Appomattox and accompanying infrastructure will be constructed per the Development Agreement to be signed by the City Council on December 14, 2006. Response: The note has been added. 4. Remove "R.O.W." from Switch Station Road. "Switch Station Road — 60 feet," is sufficient as it is not an actual right-of-way. Response: .The notation has been removed. 5. Lot 2B does not meet the minimum lot size requirements for A -O zoning. The lot must be a minimum of 5 acres to be processed prior to the rezoning. Please make adjustments accordingly. Response: The lot size ii ill meet requirements one the re -zoning is approved. 6. Please submit a TxDOT permit for the proposed driveway. The current location of the access easement meets the TxDOT comments, however the processing of the permit should begin as soon as possible. Response: The T.vDOT Driveway Permit has been submitted. 7. Please provide a survey plat showing the existing improvements on the property. If any of them are encroaching a proposed setback line, they must be removed prior to the filing of the plat. Response: A survey plat was provided at the Nov. 22, 2006 meeting. S. Provide parkland dedication for the 2 additional single family lots. Response: After the re -zoning is approved, the parkland dedication will not be required. 9. Provide note that Lots 2A and 2B are considered one building plot. Response: The note has been added to the plat. 10. Because this missed the deadline for advertising for a public hearing for a replat, the plat can still be processed for the December 7°i P&Z meeting by vacating and final platting the property. If this is the course of action, please revise the drawings to reflect "Vacating" and "Final Plat" instead of "Original" and "Replat." Also, please revise the title block appropriately. Response: The title block has been revised. 1 of TxDOT 1. The existing driveway will not meet the 425' spacing requirement, but each property is entitled to 1 access point. 2. Since the current property owners have an access driveway, the driveway shown should be shifted to the north & provide a joint access to both tracts. No additional access between Switch Station Road & Horse Haven Lane will be allowed. 3. A right -in, right -out driveway with raised divider island would be recommended. 4. A short decel lane would be recommended, since it has been offered. Responses to the comments noted above will be addressed with the TxDOT Driveway Permit. ENGINEERING The following comments should be read with the associated Gander Mountain Site Plan comments for further clarification. 1. Additional cross access easements along the rear of Lot 2A & 2B would assist future development between the two commercial lots. Response: The access easements have been added. 2. Note that access easements are maintained privately. Response: A note was added to the plat. 3. Either a blanket easement or the specific PUE for the public waterline proposed on Lot 2A should be dedicated. Response: The PUE for the public waterline on Lot 2A has been added. 4. Provide a 10' PUE along perimeter of all lots. Response: The PUEs have been added. 5. The Development Agreement needs to be addressed including the design, construction, and PUE/ROW costs associated with Appomattox Drive constructed to a minor collector classification with a Bike/Pedestrian Path and an 8 inch public water line both extending from Horse Haven Lane to the intersection of Appomattox and Switch Station Road. An engineering estimate sealed including these items and as engineering/surveying costs should be provided. Response: A note was added to the plat. 2 o f
