Dear Sir:
Our law firm represents Blake Cathey of B.A. Cathey, Ltd. Cathey Development,
Inc., General Partner of B.A. Cathey, Ltd. is the current owner of Lot 1 and Lot 2, Block 24,
Phase 12, Edelweiss Gartens Subdivision in the City of College Station. Cathey
Development has submitted requests for building permits for construction of duplexes on
these two lots. The approved and recorded plat reflects a private access easement for an
alleyway and parking at the rear of the duplexes in this phase of Edelweiss Gartens. The
private access easement is for the benefit of the owners, tenants and guests of owners in
Edelweiss Gartens - Phase 12. The submitted plans provide for shared parking of the lots
within the subdivision, including Lot 1 and Lot 2, Block 24.
After construction of the duplexes as submitted in the proposed plan, the deeds of
the respective lots and improvements will provide for a grant of a cross-easement for the
alleyway and parking area which is to be shared by the adjoining lot owners. It is the
intention of my client to grant and reserve an easement for each lot owner to have the
mutual right of use of the alleyway and parking area. It is further the intention that each
duplex have eight parking spaces specifically for the benefit of such duplexes. It is our
intention that at the time of conveyance to provide for the protection of the right to this
number of parking spaces within each owner's respective deeds through reservations and
conveyances.

use of each lot owner in the alleyway and the mutual parking, please do not hesitate to
