List the changed or changing conditions in the area or in the City which make this zone change necessary. For approximately the last 25 years, the property has been used as a permitted Type I Municipal Solid Waste Disposal Facility, as defined in Subchapter A- Classification of Municipal Solid Waste Facilities - §§ 330.5 of 30 Texas Administrative Code 330. While the active life of the facility will be approximately 5 years, the property will continue to have a heavy industrial use as a methane qas production facility and post closure monitoring activities that are required by permit. The post closure activities will continue for a mandated minimum period of 30 years. 2.) Indicate whether or not this zone change is in accordance with the Comprehensive Plan. If it is not, explain why the Plan is incorrect. This zone change is not in accordance with the Comprehensive Plan, as the plan dated November 2004 shows the land use of the subject property to be planned as Park. The plan is incorrect because, while there will be park facilities around the waste footprint of the facility, the disposal area itself will continue to have a heavy industrial use for a minimum of 30 years after closure, which is estimated to occur in 2010. Methane gas production will continue for the duration of the 30 year post closure monitoring period mandated in Subchapter K— Closure and Post Closure of Municipal Solid Waste Facilities - §§ 330.451, 330.453, 330.455, 330.457, 330.459, 330.461, 330.463, 330.465 of 30 Texas Administrative Code 330. 3.) List any other reasons to support this zone change. Article 5.3, Section F - Non-Residential Zoning Districts of the Unified Development Ordinance defines Heavy Industrial (M-2) as "designed to provide land for manufacturing and industrial activities with generation of nuisance characteristics greater than activities permitted in the C-2 and M-1 zoning districts. Permitted uses within this district are generally not compatible with residential uses of any density or lower intensity commercial uses. The applicant believes that this purpose statement is the most accurate representation of past, current, and future land use of the subject property. The applicant has prepared this application and supporting information and certifies that the facts stated herein and exhibits attached hereto are true and correct.
