According to the Unified Development Ordinance Section 3.15, the Administrator has the authority to authorize adjustment of up to 10 percent from any numerical zoning standard set forth in Articles 5, 6, or 7 of the Unified Development Ordinance. To approve the application for an administrative adjustment, the Administrator shall make an affirmative finding that specific criteria, as outlined in Section 3.15.E of the Unified Development Ordinance,have been met. The Administrator has found that: Granting the adjustment will ensure the same general level of land use compatibility as the otherwise applicable standards because the amount of the adjustment is negligible and will not significantly alter the intensity of the land use; Granting the adjustment will not materially or adversely affect adjacent land uses or the physical character of uses in the immediate vicinity because the land use is an existing development and confined to one lot;and Granting the adjustment will be generally consistent with the purposes and intent of this UDO owing to the fact that the reduction of two parking spaces is negligible. Ben McCarty, Plans Examiner, has said that for the new landing area to be compliant with ADA standards, it is to be a total of 54" out from the building and run 5' (60") along the building. This would revise your 1' x 4' addition to the sidewalk to 1.5' x 5'. Staff does not feel this would substantially affect the drive aisle. Also, the ramp would outside the landing area and may only be the 3' width if desired. If you have any questions, please contact Ben. I called Sam and he verified that the utility poles were to be taken down and he needed easements on the south and west side of the property-which is fine with Jacob. Anyway, I have two different sites I would like your feedback on. First, 1400 Athens is the Gamma Phi Beta sorority remodel. They are asking for a CO but I think we may have concerns with the tree overhanging the dumpster enclosure. I've attached 2 pictures, let me know if you feel we should require them to cut back the tree. Second, the site plan for 110 Dominik has been approved. It's the old Quick as a Flash being remodeled into a restaurant called The Pump. They're adding a dumpster enclosure in the back. Right now, there's overhead power lines (I think Verizon too) that are to be taken down as CSU will be running electric underground. From your perspective, is it possible that this project would be able to get a Temp CO with the dumpster being located outside the enclosure (and not underneath the lines) until that's completed? I appreciate your help and let me know what you think on these. We would have to place the container to the right of the proposed enclosure site until the wires are buried. We shouldn't have any problems with issuing a Temp CO.
