So, I told him that we will allow the alignment to remain as was shown on the original submittal. Because of this there is no need for Alton to improve that portion of Switch Station that actually makes Horse Haven connect to Windwood. We will not include that portion in our construction drawings at the time of final plat since this is an off-site improvement for us. Ken I have a question regarding the potential T-fare plan amendment. If Appomattox is taken off the plan due to the loop around Windwood, would Horse Haven require a 60" ROW to connect to Switch Station or could it be reduced to 50? This is really important because if it can be reduced to 50, Alton doesn't need the alley behind the lots and can access Appomattox directly. Thanks for your help, guys. Regarding the thoroughfare plan, if Council approves a plan without the Appomattox Drive thoroughfare extended through to Horse Haven Lane, Alton could build a 50 foot street with driveway access. Jane, I wanted to send out a follow-up email to talk about some of the issues with Horse Haven Phase 4 that have been floating around. First, the extension of Appomattox Drive is not solely a fire access issue. While fire access must be provided, the project must also be in compliance with both the Thoroughfare Plan and the Development Agreement that is in place for this property. As you know, the property is subject to a Development Agreement that requires that Appomattox Drive be extended southward into and through Lot 2C of Horse Haven Estates. This means that the pavement must be extended from its termination in Windwood to Horse Haven Lane. While in the past we have discussed the possibility of Oversized Participation for the extension, after looking more closely at the Development Agreement, it does not appear it is appropriate for this project. According to the Development Agreement, the right-of-way dedication and construction of the extension will be at the developer's expense. As previously discussed, staff will permit either the off-set of Appomattox or a connection straight across Switch Station Road, but the entire extension is required by the Development Agreement. Rather then include all this verbiage in an email I preferred to write a letter and attach to an email. Thought it might be easier to read. I understand the Thoroughfare Plan requirement. Compliance with the thoroughfare plan does not require that a developer make off-site improvements. Switch Station is not owned by this developer. The development agreement does not state nor imply a physical connection across Switch Station. We will be extending it southward into and through Horse Haven subdivision. We will physically connect Switch Station's south boundary with that portion of Appomattox in Horse Haven and extend it southward to provide fire access. Apparently the words "extend into and through" are vague so one must look elsewhere in the development agreement to better define. The agreement did NOT call for the engineer's estimate to include that connecting piece on Switch Station. When you look at the engineer's estimate that is part of the development agreement, the title tells you what portion is covered. It reads " APFOV'IATTOX DRIVE EXTENSION (between Switch Station Road and Horse Haven Lane) ENGINEER'S ESTIMATE OF CONSTRUCTION COSTS November 22,2006 Note the word "between". I have spoken to Kent Laza, the engineer who prepared the estimate to confirm this. That was never the intent of the development agreement to cover any portion of property other than what was included in what was originally Lot 2 of Horse Haven Estates. If you check the LF of curb and gutter in the estimate, it calls for 1881 LF. When you look at the distance across the platted lot 2C from the northern boundary of Horse Haven where Appomattox would enter if it extended straight across to where the already platted connection is made on the south end at Horse Haven Dr., you will see that the estimate only included Appomattox within the boundaries of the Horse Haven Subdivision. To include anything else would have been an off-site improvement and was never intended nor asked for by the City. This is why there is correspondence from Ken to me indicating that Mark Smith stated that there are sufficient OP funds for the City to make the connection on its property at that point in time when the City determines it should be made. Below is the email from Ken dated 2-28- 07. Jane, I spoke to Mark Smith about the questions regarding the connection between the proposed residential development and Windwood. The City of College Station will use OP funds to make the connection. We don't have any unencumbered street funds, so this is the route that we will go. Let me know if you have more questions. Please understand that Alton does not object to making the physical connection, but does object to paying for it. If the City is ready for the connection to be made and ready to stand up to the Windwood neighborhood, then we will be glad to discuss how this can best be accomplished as part of Horse Haven Ph 4, so long as the developer does not incur any additional cost for this physical connection. City staff previously agreed with the proposal to off-set Appomattox only with the understanding that the additional expense created by the off-set would be the developer's, not the City's. Although the responsibility of payment of the off-site connection has not been resolved, you have made it clear that your intent is not to cover the cost and that it may potentially become the City's burden. If the City is financially responsible for the connection, it is most prudent, from the City's perspective, to align the thoroughfare across Switch Station. Additionally, there are issues pending that may impact this subdivision and staff believes that it maybe premature for the Commission to consider this plat. The off-site connection and compliance with the Development Agreement is, of course, a primary concern. In addition, your previous correspondence refers to the East College Station Transportation Study and the potential removal of the Appomattox extension. Because staff may not support this change, and the Study will not be completed until late August, it is too early to know the fate of Appomattox. In addition, and as a point of clarification, our understanding of the development agreement is that there will be no City participation for the Appomattox extension within the bounds of the Preliminary Plat. This is to allow Council to consider a condition on the rezoning scheduled for August 6th. The developer will ask that the Council place a condition on the rezoning that the preliminary plat shows Appomattox as off-set at Switch Station. This off-set is offered to lessen any potential impact on the Windwood neighborhood relative to future cut- through traffic. As per our conversation today, if Council authorizes the off-set at their August 6th meeting, the preliminary plat will be scheduled for the August 16th P&Z meeting since this particular layout has already been reviewed by staff. If Council requires a direct alignment of Appomattox and the plat has to be redrawn, then staff will strive to schedule the consideration of the preliminary plat for the Sept. 6th P&Z meeting. In either case, the City will not require a new application form or additional application fess for the preliminary plat. This discussion before City Council is to allow Council to understand the financial impact to the City of the improvement that will be required on Switch Station Road to make the connection between Windwood and Horse Haven subdivisions. Please tell me the lot numbers you see as problems. I want to make sure we get them all. The ones on the cul-de-sacs are really difficult. You think there is any chance for variance? It doesn't seem to be a lot width or overall lot area problem in most cases but more of a depth issue. There are 5-sided lots in town and other 4-sided ones where there is enough width that you can fit a 50 X 100 rectangle but the average of the two side lines is not 100. I think this would happen only on really wide lots but I think the statement that the average of the two lines needing to be 100 is what is confusing me and Mike. That would be correct on a lot that is exactly 50' wide, which of course, a lot of these are in horse haven. Thanks Jane R. Just glancing, I see potential issues with lots 32, 33, 26, 25, possibly 18 and 19, 15, 14, 13, 12, 55, 56, 2?, 59, 60, 61, 62, 63, 64, 65, 44? The averaging comes is when a lot is REALLY close...ie: 99 feet on one side, but at least 101' on the other...not 80' and 120'. Really, it just seems that the site is being overbuilt if minimum lot sizes for the zoning district cannot be met. Give me a call if you want to discuss! Thanks! I think the problem is there is way more infrastructure than normal with all the alleys and the 70 ROW thru a relatively small property. We'll see what Mike comes up with. Even making some of the lots wider doesn't help with the depth. By the time you spread that much concrete for roads and alleys it's hard to design something that is reasonable. My understanding is that staff is willing to support variances to driveway access onto Appomattox. This is due to the turns in Appomattox (which result in lower speeds) and the fact that there will be less pavement and more backyard /green space for each homeowner by eliminating rear alleys. I think this is great and will result in a much nicer looking subdivision. We also understand that if P&Z denies the driveway variances, then we can go back and construct alleys that would be privately owned and maintained by the HOA. This will enable us to meet the minimum lot depths necessary for the lots facing Appomattox. Again, thanks guys for helping us. Mike will redraw the plat and turn it back in. On 14 December 2006, the City Council entered into a development agreement with LoneStar - College Station Golf Academy, Ltd., property owner. The terms of that agreement required the owner to provide a irrevocable letter of credit in the amount of $370,471.00 to guarantee the construction of Appomattox and associated infrastructure. It is also important to note that the existing development agreement would have to be amended by the City Council before a substitute letter of credit is provided by any entity other than the current owner (LoneStar - College Station Golf Academy, Ltd.).
