The Zoning Board of Adjustments voted (5-0) to grant the variance for the
parking island requirements for the above-referenced case. This vote was taken
at the Board's regular meeting on August 7, 2007.

1. Applicant requesting variance to UDO Section 7.2.0 interior
islands required for parking lots within 15' of a public ROW
2. Subject property zoned C-1, developed as Target and has
approximately 400' of frontage on Texas
3. TxDOT utilized ROW acquired from subject property for
Texas Avenue widening to add driving lanes and sidewalks
4. 40 spaces along Texas Avenue substandard - SHOW ON

5. Applicant reconfiguring parking area by shifting end islands

7. Since parking lot will be 6' from ROW it applies
8. Applicant concerned about loss of additional parking,
therefore asking for the variance to 4 - 18x20 islands (two
parking spaces)
9. Applicant states as special conditition that because of the
Texas Avenue widening project by TxDOT, parking spaces
along Texas Avenue are now substandard. Additionally in
order to "recover those spaces and create dimensionally
correct stalls, the drive aisle behind the stalls and the end
islands on the perpendicular parking rows must be
reconfigured."
10. Applicant further states "the hardship created with the
taking of additional ROW by TxDOT is the reduction of area
on the lot available for parking. Any additional ordinance
requirement, which causes the loss of more parking, is
extremely detrimental to the site."
11. Staff feels that ROW acquired by TxDOT placed a burden on
site that needed to be rectified
12. Staff recommends approval
