GENERAL VARIANCE REQUEST
The following specific variation from the ordinance is requested.
Section 7.2 C.7 requires that parking lots located within '15' of a public right-of-way :.'lull have
maximum of seven (7) contigous spaces separated by an eighteen by twenty-foot '1E-;x20') landscapes
island. In an effort to maximize parking. on the site we are requesting to NOTins. ,i tr

This variance is necessary due to the following special conditions:
Special Condition Definition: To justify a variance, the difficulty must be due to unique circumstance:,
involving the particular property. The unique circumstances must be related to a physical characteristic of the
property itself, not to the owner's personal situation. This is because regardless of ownership, the variance W

run with the land.
Example: A creek bisecting a lot, a smaller buildable area than is seen on surrounding lots. specimen trees.

Hardship Definition: The inability to make reasonable use of the property in accord with the
requirements of the law. The hardship must be a direct result of the special condition.
Example: A hardship of a creek bisecting a lot could be the reduction of the buildable area on the lot. when
compared to neighboring properties.

This ordinance section is related purely to aesthetics and not public health and safety. T ne narking
on the site has already been damaged by TxDOT. This Site is always fully parked during back to school
and Christmas seasons and the less of
