I'm really concerned about your 2rd comment re: platting of the adjacent 6.2 acre tract. That property was platted as part of Woodstock Section I filed October 17th, 1979;volume 430, page 481. The right-of-way issue for all three streets(Holleman, Dartmouth& Manuel)came up at the time of the conditional use permit. Please refer back to your original review comments for the CUP-particularly staff review comment#12. We responded to that comment in writing to you on April 30th, 2007 with the following statement: "ROW dedication should not be required on the 6.263 corner since it is platted. As per Section 212.904 of the Local Government Code,we believe that the request for ROW dedication for Manuel and Dartmouth is not roughly proportional to the 2.424 acre tract being developed. We request the City's determination of proportionality and the City's procedures for appeal as per Section 212.904(b)." What has changed since the CUP? Please let me know ASAP so that we can respond to the remaining comments& stay on schedule. Thanks again for all of your help Jason! I hope to further clarify them for you. Let me respond in reverse order. I do not believe anything has changed since the CUP. The CUP request was to allow multi-family units to be on the first floor in WPC. The CUP was approved with the condition that at least 9,000 sq.feet of commercial still be provided. The comment you quoted was in response to a staff comment requesting ROW dedication to be shown on the plan. Initially, it was believed metes and bounds, rezoning-like information would necessary for the CUP request. Later, it was realized a CUP could be based off an address and the more descriptive information was not necessary. I acknowledge your response comment but offer that it was not disputed because it became mute for the request at hand. As for ROW dedication, you are in possession of Ken Fogle's response to the question of rough proportionality. His response addresses the ROW dedication and extension of Manual Drive, not ROW dedication in general for Dartmouth or Holleman. Those dedications are still required as part of the plat. I had previously viewed the plat for Woodstock Section Ito which you have referred. The 6.2 acres is within an area designated"f=uture Development." However,the acreage that the plat refers to as Section I does not include that future area. In addition, other property in Future Development area has been required to plat while surveys for platting activity adjacent to the 6.2 acres have also referred to it as unplatted. I know this is not the response you have hoped for but I have tried to be descriptive in informing you of the basis for the comments I made. Let me know how you would like to proceed. This issue was discussed both verbally and in writing during the CUP process 4 months ago. The City asked us to show right-of-way dedication on the concept plan. We responded to that request and did not show it on the concept plan because of the 1979 plat. For the City to come back now and basically say that you ignored our response and are just now making this determination is absurd. Molly, please see if Bob has any time to meet with us tomorrow because this is a critical issue and a potential deal breaker for the project. Thank you. Basically,they've gone back and looked at their site plan and based on their existing plans,they will have a hard time fitting the project on their site with the ROW dedication along Dartmouth Drive north of Manuel Drive. Since the town homes south of Manuel are a stand along project, they have no problem with that dedication. They've asked several questions, including: -What is the appeal process to the rough proportionality determination? I said that City Council is the appeal body for that determination. -Could they get a variance from the subdivision regulation which requires them to dedicate the ROW? I told them that I wasn't sure if this was possible, but I would check into it and check with you guys. - Could they dedicate ROW at the corner of Dartmouth and Holleman in lieu of ROW along Dartmouth north of Manuel? From a practicality standpoint, ROW in this location would be more beneficial than the ROW that's required as part of the plat, but I'm not sure if we can do this. I'm going to try and look at my sub regs later this afternoon to get better information, but if you guys have some ideas, please forward them on. There is a portion of the building that encroaches into the 15'front setback by 3.5'. So,the administrative adjustment that we discussed won't be enough. However, could you please discuss this issue with Bob? Here's what I was thinking, could we not dedicate the ROW for Dartmouth after site plan approval? Could we utilize Section 7.1.D(2)and keep our buildings in their original location? Once the site plan is approved,we will dedicate the entire 5'of ROW for both tracts by separate instrument. The only difference in the final outcome is that a portion of the building will be 2'closer to Dartmouth. Given the dense, urban environment that we're trying to create,that shouldn't be an issue. From what I have seen, the encroachment points are on the 2 acre property being platted. Right- of-way needs to be dedicated with the plat. If not the 10 feet, then with the agreement of 5 feet along'all of Dartmouth. I will be going ahead and finalize the memo so those different points can be known by all.
