Boyett,Block 5, Lots 3,4,5 Dear Jennifer: As you know there is a sewer line that runs along the rear of the 3 lots being redeveloped by Stoneleigh. There is also overhead electric. Apparently there has never been an easement granted as these lots were developed so long ago. The City requested a ten-foot easement along the rear to cover the existing electrical and sewer lines. Stoneleigh is happy to dedicate an easement, but encountered some difficulties when the architect and engineer began to design the site with the ten-foot easement width required by the subdivision regulations. More specifically, the stairs on the back of the building necessary for fire access require additional space so as to not encroach into the easement. I spoke to the Electric Department(Brent Read who talked to Tony Miichalsky) and they are fine with a 7.5 foot easement. As you mentioned today, utilities(Spencer Thompson) is fine with the 7.5 foot easement as well. The sewer line is actually on the property behind these three lots being redeveloped. Therefore, we are resubmitting the replat showing a 7.5 utility easement along the rear. I understand this actually requires a variance from the P&Z. as part of its consideration of the replat. As per Section 5 of the Subdivision Regulations we offer the following for consideration of this variance request: 5-A.1 —These lots, platted many years ago were originally laid out and dimensioned anticipating low density single family and duplex units. Now the City desires to increase densities in the Northgate area and as such, Stoneleigh is proposing a multi-story apartment complex on this property. The lots are small and while there was sufficient room for the individual lower density units, it is a challenge to design a high density project. We need an additional 2.5 feet of useable area in the rear to reasonably develop a denser project with safe and adequate fire access. 47 511 University Drive East, Suite 211 College Station, TX 77840 979-846-9259 www.IPSGroup.us 5-A.2—This variance will enable the owner/developer to create the kind of development that will meet both the City's master plan for a more dense urban environment in Northgate and enable him to develop the site economically and safely. 5-A.3 -The granting of the variance will not be detrimental as both necessary utilities can adequately exist within the 7.5 foot dedication. 5-A.4—This variance will not preclude any other lots from redeveloping or subdividing in an orderly fashion. As lots to the rear of these lots redevelop over time, additional easement width can be gained.
