I spoke with a few other staff members and the consensus is that when this exact question has been brought to our legal department in regards to recent cases, our legal department has not allowed for right of way dedications on final plats that are encumbered by pre-existing private easements. I would recommend that any further questions regarding this subject be brought to the attention of our legal department. I have also attached the letter referenced in Engineering Comment#12.
