Dear Mr. Burch:
As you are aware, a building permit was issued for the two duplexes located at 508 and
506 Cooner in August of 2006. As part of the approval process a site plan was required
to be approved showing the required parking spaces and provided as well as parking
setbacks, building setbacks and landscape/irrigation plans. At the time of permit, the site
plan met all of the requirements. The site plan did not show any existing large canopy
trees, existing easements or electrical lines. However, when the applicant requested the
Certificate of Occupancy, staff discovered during the site inspection that the applicant
did not build the site to the approved plan and is now lacking three required parking
spaces.
In the Unified Development Ordinance, Section 7.2 Off-Street Parking Standards,
requires two parking spaces per Dwelling Unit. This required you to apply for a parking
variance to the Zoning Board of Adjustments that was scheduled for January 2, 2007.
This variance was denied and therefore requires you to come into compliance by
constructing three additional parking spaces. You were to construct to the originally
approved site plan. It has come to staff's attention that these parking spaces have yet to
be constructed; therefore the City of College Station is requiring you to have the parking
spaces constructed per the original approved plan by May 31, 2007. This is 20 business
days to complete this work. Please contact Planning and Development Services upon
completion of this project for final inspection.
Any violation of the Unified Development Ordinance or any other Section of the Code of
Ordinances is considered a misdemeanor and shall be punished by a fine not to exceed
Two Thousand Dollars ($2,000.00). Each day the violation continues, shall be
considered a separate offense.
