I was suggesting a development agreement where the developer provided cash surety to construct the remaining street
section along with the dedicating ROW. The agreement would could have agreed stipulations as to the timing of the future
construction but I wasn't envisioning a default as the trigger to construct. These funds could be given to the future
adjacent developer as well to make the tie-in.
In Article IX of the County Subdivision Regulations do have provisions for bonding streets and drainage to allow associated
final plats to be filed ahead of construction. They specify construction bonds, Unconditional Guarantees, and Cash for
security. Distinct from the City,they have a set cost per linear foot of street where we require a specific engineer's
estimate. If we determined we could "hold"the cash surety, I would think we would require an engineer's estimate and see
how it compares to the linear footage cost per County-and require the greater of the two. I'll drop off a copy of the
County's Sub Regs.
To restate my question, is it appropriate for the City to have a development agreement in the ETJ and hold cash surety for
a County Road? I spoke with Gary Arnold at the County Engineer's Office on this topic. He is not aware of the County
entering into to such an agreement, but he will ask their legal counsel if they object to the City entering this agreement or if
the County might prefer.

If the City is reviewing this plat pursuant to the ILA with the County,the City can enforce our subdivision regs in the
event that our regulation is the more restrictive. We talked yesterday about Indian Lakes guaranteeing around the
construction of the street under section 7 of our subdivision regs. So you should probably look at the county's
subdivision regs to determine if they have language that is more restrictive than ours. Also, which entity will enforce
the guarantee should the developer default?

PLANNING
1. As discussed in the prior submittal, please refer to Phase 1 Resubdivision Plat for benchmark and
control information. This plat's "Point of Beginning" (POB) is established at the northwest corner
of Phase 1, Block 1, Lot 4.
2. Mr. Bermudez travels out of state frequently, we will provide an authorization letter as soon as we
can make contact with him.
3. This is no longer an issue with this Plat submittal.

information on the Ordinance that establishes the right for the City to determine and/or regulate
the analysis required to determine a project's financial feasibility.
