As for the public utility easement (PUE) we discussed the other day, Helen told me yesterday, she finally got a response from Cox Cable that day, the only remaining issue we've been waiting on for weeks to be able to send application to the city. Cox Cable said they were signing the statement that there were no utilities there and sending it to her. So she should have that from them by Monday and will send the completed application on to the city for their next meeting. As for the original site plan, I thought you were aware, that was the whole reason we were having to get this approved by the city. The city had messed up and now we're trying to get it straightened out. When we first began work on this project, Todd had an architect draw up a "conceptual" site plan to turn in to the city for approval for a zone change to allow townhomes on the property. Afterwards the engineers did their topo studies and went to work on the actual site plan, which changed considerably, to allow for drainage requirements, allowable entryways off of public roads, etc. Then the city had them change things again for garbage and emergency fire vehicle access, etc. Finally, the city approved the final plat to be built, which did NOT include a pool or other amenities. So there was no plan to build a pool. Later, Todd started advertizing we were going to build a pool afterall, assuming he could build it on the site he still hopes to build it on, in the common area. Now the city has come back and said we can't build it there, due to a PUE. Todd knew there were no utilities there, but hadn't noticed that the plat had designated the area for utilities (PUE). Hence, we are applying to have the PUE removed by the city, in hopes the city will then approve the site for the pool. However, I believe Todd is right, there is not room for a Gazebo in addition to the pool. He never advertized a Gazebo or other amenities, those were only on the original "conceptual" plan, which the city did not approve on the actual final plat of the site, so they should not have ever brought it up again. MOst homeowners feel Todd is dragging his feet and could do so for a long time if we don't put a firm deadline in front of him with acceptable plans for both the city and homeowners.
