COMMENTS: 1. Veronica Morgan explained that Mitchell and Morgan are responsible for engineering within the proposed property line. Civil Development Ltd is responsible for utilities, access and permitting outside the property line. 2. The project excludes improvements to the existing Arrington Road intersection with SH 40. Upon completion of the Arrington Road realignment the road will be converted to a private drive by the Seller. 3. The existing Arrington Road location is acceptable to Tx DOT even though it is currently located less than the recommended distance of 425'from SH 6 provided that future access is limited to"rig ht-in and right-out" only. 4. When the Arrington Road realignment is complete, Tx Dot will not abandon Arrington Road ROW. The seller will apply for a driveway permit instead. 5. Bob Appleton will determine what landscape improvements can be made within the TxDOT ROW. 6. Joe Schultz reported that Wellborn SUD will agree to sell their parcel if Seller agrees to bear the cost to lower the existing waterline and make other improvements (i.e. bury the concrete vault). 7. Bob Appleton stated that the new private drive off of SH6 must be a minimum of 500" from the intersection and accommodate a new deceleration lane. The driveway could be greater than 500' from SH40. 8. Bob Appleton stated that a deceleration lane on SH40 to the new private drive will be required when the Arrington Road realignment is complete. 9. Once Arrington Road realignment is complete, the Seller will provide Citigroup with access to the "old Arrington Road" However this will probably NOT be a direct connection. 10. Carol Cotter reported that the CoCS master utilities plan need not be amended to reflect proposed utilities changes. Carol Cotter also reported that the water lines serving the property will probably be installed by September 2007. 12. The Seller agreed to generate and file the final plat for the project. 13.
