HomeMy WebLinkAboutStaff Report STAFF REPORT Project Manager: Jennifer Prochazka, AICP, Sr. Planner Report Date: August 27, 2007 Email: jprochazka@cstx.gov Meeting Date: September 6, 2007 Project Number: 07-00500188 Item: Presentation, possible action, and discussion on a Variance Request to Section 8-M.1 of the Subdivision Regulations (Sidewalks), and a public hearing, presentation, possible action, and discussion on a Final Plat of Horse Haven Estates Lots 2B-1, 2B-2, and 2B-3, being a replat of Horse Haven Estates Lot 2B, consisting of 4.521 acres located at 2297 Earl Rudder Freeway South, and more generally located on the east side of Earl Rudder Freeway north of Horse Haven Lane. Applicant: Dick Waring, agent for Beeson Properties, property owner Staff Recommendations: Staff recommends approval of the replat. If the variance request is denied, the construction documents will have to be revised to reflect the required sidewalk. Item Summary: This item is for a replat of Lot 2B of Horse Haven Estates into three commercial lots. The property is zoned C-1 General Commercial. The applicant has requested a variance to Section 8-M.1 of the Subdivision Regulations, relating to sidewalks. Section 8-M.1 requires sidewalks along roadways with a right-of-way width greater than fifty-feet. While Earl Rudder Freeway does have a right-or-way width in excess of fifty-feet, staff does not believe that it is appropriate to have a sidewalk adjacent to the frontage road. Comprehensive Plan Considerations: The Land Use Plan designates this property as Regional Retail. Earl Rudder is designated as a freeway on the City's Thoroughfare Plan. Item Background: The subject property was annexed in 1971 and 1977, and subsequently zoned A-O, Agricultural Open. The property was rezoned C-1 General Commercial in December 2006. The property was platted in 1998 as a part of Lot 2 of Horse Haven Estates and was vacated and platted again in December 2006.
