I checked the site plan file and was not able to find an access easement so it probably was not formalized.As for it connecting,
they constructed the drive aisle stub as shown on their approved site plan so they knew about it back then. Cross access to it is
required as part of the Cottages PDD so it would need to connect.
As for why, it will be of mutual benefit for both property owners in the long-term.At some point,TxDOT is going to place a
median on that portion of Harvey Mitchell Parkway and/or add frontage roads. In either scenario,their driveway would likely
become right-in/right-out. Having that connection will allow their residents to make their way to Holleman to travel north or
west instead of darting across lanes of Harvey Mitchell to turn or u-turn at the signal.Also, Cottages area residents could enter
and exit without having to go around through Holleman.
While not the preferred situation, not having an access easement does not stop the connection from occurring on the Cottages
side. While technically they could put a gate up as there is not an easement on their side, I'm hopeful that the benefit to them
will be realized now or at some point in the future.

Subject: Capstone Cottages - Cross Access with 2818 Place
Jason,
can you do some checking for me? Can you locate on 2818Place the public access easement that covers that drive that
they stubbed out to us? I dont seem to find it on the plat and we are talking with those folks now and they are balking at
us connecting to them. It may have been shown on the site plan with a separate instrument easement and I just dont
have that information.
I am afraid if they did not dedicate a cross access easement or public access easement for us this idea of cross access
may be dead. They dont want us to connect to them and I am having to explain why it is good for both of us and that it
is a city requirement.
They dont understand how the city can require this.
