Travis-
I looked into the sidewalk issue that we discussed yesterday, and the sidewalk does need to be shown on
the preliminary plat and in the construction documents unless a variance is requested. If the sidewalk
is provided, it should be provided in accordance with the BCS design guidelines, and I can provide you
with the site plan that we have on file for A&M Super Storage for the location of the sidewalk connection
they are showing. I understand your concern that this is not an approved site plan, but the only
remaining issues that we have relate to the provision of water and sewer to serve the development.

Is a variance request to omit ROW sidewalks a City Council review item? I am basing this question from
reading the Sub Reg's 8-M.6

Travis-
The City Council has delegated the authority to hear variances to the Subdivision Regulations to the
Planning and Zoning Commission and it is Staffs interpretation that this variance can be heard by the
P&Z. However, if you want to take it to City Council we can do that too. Let me know.

CC: <ehkthrl@msn.com>, "Lindsay Boyer" Iboyer@cstx.gov
Travis,
I spoke with Josh and Lindsay yesterday.
Josh mentioned 2 minor items needed from us, plus a Legal Easement signed:
(1) additional valve ---which he will send to you via a separate email and
(2) $200 Development Fee I will have my Secretary bring that to P & D today.
I have also dropped on the Legal Easement, which Deborah Grace gave to me this morning,
and which you have indicated that Paul (and Mid-South) will sign on Monday. Let me know
if my understanding is correct on that Travis, thanks!
It is my understanding that getting in these items, it keeps our project on Preliminary and Final
for September 20th.
I wish to thank you, Travis, Lindsay, and Josh for all of your hard work on this project.
Sincerely,
Hub

Subject: Minutes approving Zoning and Platting & Meeting re North Access Road
CC: 'Travis Martinek" TMartinek@ClarkeWyndham.com
Lindsay,
Please allow me to thank you for all of your help on this project.
I believe the City has been most helpful!
First, my Bank needs a copy of the (1) Minutes approving the Prelim/Final Plat of last night and
(2) the Minutes approving the zoning of the property for this use.
Can you email that to me today?
Secondly, I would like to set up a meeting to discuss the north access easement with you, me, and
Travis next Monday. What time is possible?
Thanks,
Hub

Hubbard-
The draft minutes for last nights meeting will not be ready for at least a week. The approved minutes will
not be available until the next meeting (October 4). Attached are the minutes from the City Council
meeting which ultimately approved the rezoning.
As far as the access easement is concerned, I understand there is a meeting regarding this issue already
setup for Tuesday afternoon.

Hubbard,
The minutes for last night's Planning &Zoning Commission have not yet been drafted and will not be
approved until the next meeting on October 4th. For you records, the variance to the sidewalk
requirement, the Preliminary Plat, and Final Plat for Animate Habitat Phase 1 (Agenda Items 5 &6) were
all approved unanimously by the Commission.
As for the rezoning from A-O to C-2, Commercial-Industrial, I was not able to obtain the minutes for that
Council meeting. I have attached, however, the signed ordinance that made the change and hope that
will suffice. Let me know if I can assist you further.
Regards,
Jason
